Since the first days of state independence, Kazakhstan has been purposefully and gradually following the course of creating effective anti-corruption institutions and mechanisms that meet international standards.
According to the current Legislation of the Republic of Kazakhstan "On Public Service of the Republic of Kazakhstan ", public service is the activity of civil servants in state bodies for the execution of official powers aimed at the implementation of tasks and functions of state power.
In accordance with article 52 of the above-mentioned Law:
Civil servants must resist manifestations of corruption and prevent corruption offenses.
Civil servants must prevent the facts of corruption offenses on the part of other civil servants.
If a civil servant has information about a corruption offense, he must take the necessary measures to prevent and terminate such an offense, including immediately informing in writing the superior head, the management of the state body in which he works, the authorized state bodies. A civil servant is also obliged to immediately inform the specified persons and bodies in writing about cases of inducement by other persons to commit corruption offenses.
The management of the state body is obliged, within a month from the date of receipt of the information, to take measures on the statements of a civil servant about corruption offenses, cases of inducing him to commit these violations, including by organizing inspections and sending appeals to the authorized bodies.
The management of a state body is obliged to take measures to protect a civil servant who has reported cases of corruption offenses, inciting him to commit these violations, from prosecution that infringes on his rights, freedoms and legitimate interests.
Civil servants should not allow actions (inaction) that make it difficult for individuals and (or) legal entities to exercise their rights, freedoms and legitimate interests.
If an unfounded public accusation of corruption is brought against a civil servant, he must take measures to refute it within a month from the date of discovery of such an accusation.
