According to the law of the Republic of Kazakhstan" on protection of consumer rights", the buyer has the right to return the goods of proper quality within 14 days from the date of purchase, if it is not used, it must have a preserved commodity type, consumer properties, seals, labels and have a document confirming the fact of purchase. However, in practice, consumers often refuse sellers, which is a violation of the legislation. Common reasons for refusal Some stores refuse to return the goods, referring to internal regulations that contradict the law. Among the most common arguments are the following: • "If the goods are not defective, there will be grounds for refusal" * "Refund is possible only on the day of purchase"; * "The lack of factory packaging is grounds for refusal." All these arguments are illegal, since the law clearly establishes the right of the consumer to return the goods of the appropriate quality within the established time frame. What goods cannot be returned? Indeed, there is a list of non-refundable goods, which includes: - medicines and medical devices; - underwear; - hosiery products; - animals and plants; - the goods sold in meters, in particular, fabrics made of all kinds of fibers, textile and curtain canvas fabric, artificial leather, carpet products, non-woven materials, ribbons, lace, tape, wires, cords, cable, linoleum, baguette, film, oilcloth; - subscriber device of mobile communications. If the goods are not included in this list, the seller is obliged to take it back, provided that all the conditions for its return are met. How to protect your rights? If the buyer is refused to return the goods of proper quality, in accordance with paragraph 1 of Article 30 of the law of the Republic of Kazakhstan "on protection of consumer rights", they can perform the following steps: 1.contact the store in writing with a return request. 2. in case of refusal to send a complaint to the Department of trade and consumer protection of the SIM of the Republic of Kazakhstan in Kostanay region 3.go to court to defend your rights. An important tool in the fight against unscrupulous sellers is the awareness of consumers about their rights. State bodies and public organizations urge citizens to actively defend their interests without violating the norms of the law.
