The Department of the Agency for the Protection and Development of Competition of the Republic of Kazakhstan for Kostanay Region (hereinafter - the Department), in pursuance of the instruction of the Head of State of the Republic of Kazakhstan K.K.Tokayev, regarding strengthening control to prevent price increases for socially significant food products (hereinafter – NWPT)and essential goods during the period of the emergency regime of natural and man-made nature, as well as the instructions of the Deputy Prime Minister of the Republic of Kazakhstan G. Koishybayeva No.21-07/1957, regarding the suppression of speculative manifestations on the part of unscrupulous entrepreneurs in the flood zones to increase prices for agricultural products and essential goods, reports the following.
According to article 160 of the Entrepreneurial Code of the Republic of Kazakhstan, the objectives of state regulation of competition are, inter alia, the prevention of possible violations of antimonopoly legislation.
Unjustified restrictions on production and sale, unjustified price increases for socially significant food products may be considered by the Department for anticompetitive coordinated actions aimed at setting and maintaining prices, unjustified restrictions on the production or sale of goods, abuse of a dominant position prohibited by the Entrepreneurial Code of the Republic of Kazakhstan.
At the same time, for committing such actions, Article 159 of the Code of the Republic of Kazakhstan on Administrative Offenses provides for administrative liability in the form of negotiable fines from 3% to 5%, with confiscation of all monopoly income.
In order to prevent unjustified growth in socially significant food products and to avoid investigations of violations of antimonopoly legislation on such facts and the adoption of appropriate antitrust response measures, we inform you about the need to carry out our activities in strict accordance with the current legislation of the Republic of Kazakhstan.
