Anti-corruption

The anti-corruption strategy of the Republic of Kazakhstan for 2015–2025 in the anti-corruption system, the fundamental link is the identification and minimization of corruption risks, conditions and reasons accompanying their occurrence.

In this regard, in order to eliminate the causes and conditions of corruption in the public and private sector, for the first time, the Law of the Republic of Kazakhstan dated November 18, 2015 "On Combating Corruption" (hereinafter - the Law) introduced corruption prevention institutions such as anti-corruption monitoring and analysis of corruption risks (external and internal).

The Decree of the President of the Republic of Kazakhstan dated December 29, 2015 No. 155 approved the Rules for conducting an external analysis of corruption risks, which determine the procedure for conducting it in the activities of state bodies and organizations, subjects of the quasi-public sector, with the exception of special state bodies.

The standard rules for internal analysis of corruption risks and the Rules for anti-corruption monitoring were approved by orders of the Minister for Civil Service Affairs dated December 29, 2015 No. 18 and No. 16, respectively.
Anti-corruption monitoring is the activity of anti-corruption actors in collecting, processing, generalizing, analyzing and evaluating information related to the effectiveness of anti-corruption policy, the state of law enforcement practice in the field of anti-corruption, as well as perception and assessment of the level of corruption by society.

Anti-corruption monitoring is carried out by the authorized body and other anti-corruption entities.

In the course of anti-corruption monitoring carried out by the authorized anti-corruption body, the activities of state bodies, organizations and subjects of the quasi-public sector on anti-corruption issues are studied; publications in the media and appeals of individuals and legal entities on anti-corruption issues; data from legal statistics bodies.

One of the elements of anti-corruption monitoring is to consider the results of opinion polls on the perception of the level of corruption and countering its manifestations.

The results of anti-corruption monitoring carried out by other anti-corruption entities are summarized by the authorized anti-corruption body. When summarizing the results, quantitative and qualitative indicators characterizing the state and causes of corruption in the activities of state bodies, organizations, quasi-public sector entities, as well as assessment, conclusions and proposals for improving the anti-corruption measures taken by anti-corruption entities are necessarily taken into account.

On a quarterly basis, the authorized anti-corruption body prepares an analytical report reflecting the assessment of the current situation in the anti-corruption sphere, and one of the decisions is made based on the results of anti-corruption monitoring: development of proposals to improve the efficiency of anti-corruption subjects; analysis of corruption risks in the activities of anti-corruption entities.

According to paragraph 4 of Article 7 of the Law, the results of anti-corruption monitoring can be the basis for analyzing corruption risks, as well as improving measures aimed at creating an anti-corruption culture.

Analysis of corruption risks - identification and study of the causes and conditions conducive to the commission of corruption offenses.
The basis for conducting an external analysis of corruption risks is a joint decision of the first heads of the authorized body for combating corruption and the object of external analysis of corruption risks, and in their absence, persons performing their duties or replacing their positions.

An external analysis of corruption risks is carried out within a period not exceeding 30 working days by a working group created by a joint decision. The authorized body has the right to involve specialists and (or) experts of other anti-corruption entities in the external analysis of corruption risks.

Analysis of corruption risks includes the stages of collecting, summarizing, analyzing information and drawing up an analytical report.

Analysis of corruption risks is carried out in the following areas:
1) identification of corruption risks in regulatory legal acts affecting the activities of the object of external analysis of corruption risks;
2) personnel management, including staff turnover;
3) settlement of conflicts of interest;
4) the provision of public services;
5) performance of licensing functions;
6) implementation of control and supervisory functions;
7) other issues arising from the organizational and management activities of the object of external analysis of corruption risks.

Based on the results of an external analysis of corruption risks, an analytical report is prepared in two copies, containing information on the identified corruption risks and recommendations for eliminating the identified corruption risks.

The analytical report is agreed by the members of the working group and signed by the officials of the authorized body and the object of external analysis of corruption risks identified in the joint decision.
Within 6 months from the date of signing the certificate based on the results of the external analysis of corruption risks, monitoring is carried out by the objects of the external analysis of corruption risks of the recommendations to eliminate the causes and conditions conducive to the commission of corruption offenses, made as a result of the external analysis of corruption risks.
Internal analysis of corruption risks is carried out by a structural unit, an official (officials) determined by the first head of the subject of internal analysis of corruption risks or a working group created by his decision.
The results of the internal analysis of corruption risks are posted on the Internet resource of the subject of internal analysis of corruption risks.
Public discussion of the results of internal analysis of corruption risks is allowed, including at meetings of collegial, consultative and advisory anti-corruption bodies of the subject of internal analysis of corruption risks, with the exception of special state bodies and public organizations.
