In accordance with paragraph 2 of Article 35 of the Entrepreneurial Code, natural persons who meet one of the following conditions are subject to compulsory state registration as an individual entrepreneur:
1) use the labor of employees on a permanent basis;
2) have an annual income from private entrepreneurship, calculated in accordance with the tax legislation of the Republic of Kazakhstan, in an amount exceeding 12 times the minimum wage established by the law on the republican budget and effective as of January 1 of the corresponding financial year.
What do you need to open an IP?
IP registration is carried out in one of two ways:
• by personal submission of the necessary documents to the State Revenue Department at the location of the business;
• by submitting documentation through the egov.kz state portal. In this case, the applicant must have his own electronic digital signature.
A citizen or an oralman will only need to submit a completed notification. The form of this document can be taken from the state revenue authority or downloaded from the e-government website.
If the applicant is still a minor, then one of the available documents will need to be attached to the notification:
• consent of parents, guardians, acting as legal representatives;
• proof that the person has been recognized as legally capable (copy of marriage certificate, decision of the board of trustees or court).
If it is planned to open an individual entrepreneur of a joint type, then the person authorized to register the business must provide a power of attorney signed by all participants.
After registration, the individual entrepreneur must decide on the choice of the taxation system. By default, an entrepreneur will work according to the established tax regime.
In Kazakhstan, the registration of entrepreneurs has acquired a notification rather than declarative character, as before.
Because of this, the list of necessary documents that must be submitted to the tax authority has been significantly reduced. In general, you just need to submit a notice of starting a business.
