On the civil service of the Republic of Kazakhstan

Law of the Republic of Kazakhstan dated May 19, 2026, No. 290-VIII ZRK.

Article 12. Ethics, Impeccable Reputation

Civil servants are obligated to observe professional ethics, maintain an impeccable reputation, and refrain from actions and behavior that could cause negative publicity or discredit the civil service.

The Ethics Code of Civil Servants of the Republic of Kazakhstan is approved by the President of the Republic of Kazakhstan.

Violation of professional ethics by a civil servant entails disciplinary liability established by this Law, up to and including dismissal from civil service.

The impeccable reputation of a civil servant or person applying for a civil service position includes a combination of personal, ethical, and professional qualities associated with the absence of circumstances that would prevent them from entering and maintaining civil service.

A civil servant or person applying for a civil service position is not considered to have an impeccable reputation if there are grounds for denial of employment or an outstanding disciplinary sanction for committing a disciplinary offense that discredits the civil service or for failure to comply with official ethics.

Article 47. Guarantees Related to Working Hours

Work on weekends and holidays is permitted with the written consent of the civil servant based on an act of the government agency, except for cases provided for in paragraph 3 of this article.

For work on weekends and holidays, the civil servant shall be paid at an increased rate, not less than time and a half, based on the civil servant's daily rate.

When planning wage expenses for work on weekends and holidays, their amount is set at one percent of the total number of staff positions of the government agency approved for the relevant financial year.

At the request of a civil servant assigned to work on weekends and holidays, they are granted appropriate days (hours) of rest.

Pregnant women who have provided their employer with a pregnancy certificate, and individuals with disabilities, are not permitted to work on weekends and holidays.

Assigning a civil servant to work outside established working hours (overtime) at the initiative of a government agency is permitted with the civil servant's written consent based on an act of the government agency, except for cases provided for in paragraph 3 of this article.

Overtime work must not exceed two hours during the workday. The total duration of overtime work must not exceed twelve hours per month, except for cases provided for in paragraph 3 of this article.

When working overtime, the civil servant is granted days (hours) of rest for the overtime hours or receives additional pay for overtime work in accordance with the labor legislation of the Republic of Kazakhstan.

Pregnant women who have provided their employer with a pregnancy certificate, as well as individuals with disabilities, are not permitted to work overtime.

Overtime work and work on weekends and holidays without the consent of the civil servant is permitted in the following cases:

1) to prevent emergencies, natural disasters, or industrial accidents, or to immediately eliminate their consequences;

2) to prevent and investigate work-related accidents, deaths, or property damage;

3) to perform urgent, unforeseen work, the prompt completion of which is essential to the continued normal operation of the government agency as a whole or its individual structural divisions;

4) during the imposition of a state of emergency or martial law, or the introduction of other restrictive measures, including quarantine, as well as in other exceptional cases that pose a threat to human life or health;

5) in other cases stipulated by the laws of the Republic of Kazakhstan.
