According to subparagraph 22) of Article 1 of the Law of the Republic of Kazakhstan "On Rehabilitation and Bankruptcy", the authorized body in the field of rehabilitation and bankruptcy is the Department of State Revenue for the city of Shymkent, which carries out state regulation provided for by the Law "On Rehabilitation and Bankruptcy", other laws of the Republic of Kazakhstan, acts of the President of the Republic of Kazakhstan and the Government of the Republic of Kazakhstan.
According to paragraph 1) of Article 90 of the Law of the Republic of Kazakhstan "On Rehabilitation and Bankruptcy", for the purpose of forming a register of creditors' claims, a temporary manager no later than two working days from the date of the court ruling on the initiation of bankruptcy proceedings, and if the applicant is a creditor for taxes and customs payments or a state body or a legal entity with the participation of states, – from the date of his appointment , he sends to the authorized body an announcement on the initiation of bankruptcy proceedings and the procedure for filing claims by creditors in Kazakh and Russian for posting on
the authorized body's Internet resource www.shymkent.kgd.gov.kz
By Resolution of the Government of the Republic of Kazakhstan dated July 2, 2014 No. 762 "On approval of forms, Rules and deadlines for the formation of the register of creditors' claims", claims must be submitted no later than one month from the date of publication of the announcement on the procedure for filing claims by creditors and sent to the address indicated in the announcement.
The application is accompanied by copies of documents confirming the basis and amount of the claim (court decisions that have entered into force, copies of contracts, recognition of debt by the debtor) with simultaneous submission of original documents for reconciliation.
Creditors have the right to submit other documents confirming the basis and amount of the claim.
The creditors' claims recognized by the interim manager are included in the register. A creditor's claim filed later than the deadline, in case of recognition, is included in the register, but such a creditor is deprived of the right to vote in the creditors' meeting until the creditors' claims filed within a month are fully satisfied.
