One of the tasks and functions of the Department of State Revenue in Shymkent is to monitor compliance with the requirements of the technical regulations of the Eurasian Economic Union.
The certification of building materials is designed to address issues related to the protection of consumer interests and rights. The certification procedure for building materials is carried out so that the construction does not harm the health, does not endanger the lives of those who will live in the buildings and premises under construction.
By Order No. 435 of the Minister of Industry and Infrastructure Development of the Republic of Kazakhstan dated June 9, 2023, the technical regulations "On the safety of buildings and structures, building materials and products" were approved. This order came into force on December 19, 2023.
This technical regulation introduces mandatory certification of 77 types of building materials and products (gypsum, lime, all types of cements, clinkers, bricks, pebbles, gravel, crushed stone, adhesives, putties, paving stones, granites, stones, limestones, shales intended for construction).
But not all importers of building materials comply with these requirements. So, in six months we have identified 195 customs declarations for which certificates of conformity were not submitted during customs clearance of construction materials when imported into the Republic of Kazakhstan.
According to all facts of violations, customs representatives were brought to administrative responsibility, fines were imposed for a total amount of 7,614,750 tenge. Information about companies that imported building materials for taking appropriate measures in relation to them has been sent to the standardization and metrology authority.
In this regard, in order to prevent the import of non-certified products and protect Kazakhstani consumers, the Department of State Revenue for the city of Shymkent organized a round table on November 13, 2024, in which we highlighted problematic issues and ways to solve them with the participation of companies importing construction materials, customs representatives and conformity certificate confirmation authorities. Representatives of the Chamber of Commerce and Industry, the Department of Technical Regulation and Metrology in Shymkent and the Union of Builders of Kazakhstan will also be present.
Compliance with measures of technical regulation of motor vehicles, including OTTS
According to paragraph 10 of the Decision of the Council of the Eurasian Economic Commission No. 130 dated November 12, 2021, the use of documents specified in paragraph 4 of the Procedure to confirm compliance with technical regulation measures in respect of imported (imported) products is allowed if the declarant of such products is:
a) the person indicated in such documents as an applicant for conformity assessment This product has mandatory requirements;
b) the person(s) specified in the vehicle type approval (chassis type approval);
c) a person authorized by the applicant during the conformity assessment or by the manufacturer to use such documents to confirm compliance with technical regulation measures – for mass-produced products. The right to use such documents is confirmed by providing the specified person with copies of them, stamped by the applicant during the conformity assessment or by the manufacturer.
In this regard, for the customs clearance of vehicles, we see the need to be guided by subparagraph b) of paragraph 10 of the Procedure.
Taking into account the above, the Committee informs that from December 1, 2024, when placing vehicles under the customs procedure for release for domestic consumption, it is necessary to accept approval of the type of vehicle as confirmation of compliance with technical regulation measures (hereinafter – OTTS) exclusively by legal entities specified in the approval of the type of vehicle, and in the case of the provision of OTTS by the persons specified in subparagraph (c) of paragraph 10) of the Decision to pay attention to the purpose as for mass-produced products, from the date of manufacture of which less than 3 years have passed.
