The current Tax code provides for the application by authorized economic operators of a deferred payment of value-added tax on imports, subject to certain conditions.
According to the amendments to article 399 of the Tax code, the import of goods for which the term of payment of indirect taxes has been changed in accordance with paragraph 10 of article 49 of the code and the requirements established by article 457 have been fulfilled is exempt from value added tax.
The procedure and conditions for applying the exemption from value added tax when importing goods are approved by the authorized body.
In case of violation of the procedure for confirmation of export of goods the value added tax on imported goods shall be payable with accrued interest from the date set for the payment of value added tax on imported goods, in the manner and amount defined by the customs legislation of the EEU and the customs legislation of the Republic of Kazakhstan.
Thus, the Law introduced an amendment providing for exemption from value-added tax on imports for a certain category of taxpayers of value-added tax for which a deferred payment of value-added tax on imports is applied, provided that previously imported goods are exported to the EAEU member States.
