As soon as the age and the amount of savings allowed, I transferred part to the insurance company. Now I would like to return some of it to the pension fund again. Is it possible?
Since 2003, our citizens have the right to conclude pension annuity agreements with life insurance companies (hereinafter referred to as CSW). Such an agreement allows citizens, without waiting for retirement age, to receive regular payments from the CSF, taking into account annual indexation (at least 5%) for life.
The Law of the Republic of Kazakhstan on the development of the insurance market, put into effect on September 12, 2022, citizens who have a pension annuity agreement are granted the right to partially refund money from the CSF back to the UAPF.
In the implementation of the Law, on October 20, 2022, a corresponding regulatory legal act (NPA) was adopted, which comes into effect after 10 calendar days after its official publication, namely from November 8, 2022.
From this date, citizens who have a pension annuity agreement can apply to the CSJ with an application and return to the UAPF a part of the insurance premium exceeding the minimum cost of the pension annuity agreement.
To do this, the pension annuity contract is renegotiated on new terms, which should ensure payments at a level not lower than 70% of the subsistence minimum.
Insurance organizations are obliged to transfer the amount of money to be refunded to the UAPF within 20 calendar days from the date of the insured's request.
Recently got a job as a courier in a small private company. How do I find out if pension contributions are coming to my individual account and how to do it?
Firstly, having got a job, you must necessarily formalize the relationship with the employer by concluding an employment contract or a civil contract. In both cases, the employer (tax agent) is obliged to transfer monthly mandatory pension contributions (OPV) to your individual pension account in the amount of 10% of your earnings. In order to make sure that he faithfully fulfills his obligations to transfer contributions, their receipt to the account must be monitored.
The UAPF offers investors various methods. To date, the most popular is the personal account on the Foundation's website and in the BZHZK/UAPF mobile application.
Using an EDS or IIN and password, you can log into your Personal Account at any time and view your retirement savings and the receipt of funds.
To do this, you go to the Foundation's website, where in the upper right corner there is an icon with the corresponding inscription: "Personal Account". Click on it and then select "Personal Account". Registration is required for beginners.
If you have an electronic digital signature, it will be useful to you in two cases. Firstly, with the help of an EDS, you just go into your office. But a digital signature has its own expiration date, and although it is quite simple to re-register it on the egov portal, it is better to do the following right away with its help. You go to your Personal Account – to the "Services" section - making changes and additions to the details and choose the "Method of informing" - the INTERNET.
If there is no EDS, then you visit any branch of the UAPF once and choose the INTERNET as a way of informing there. After that, you will be able to log into your personal account using the IIN and the password you have chosen.
In the upper left corner there is a function "Services", clicking on which you get to the general section with services. You need to get an extract from an individual retirement account. Specify the period you are interested in, then you can download the received statement to your computer or, if desired, send it by email.
Through the personal account, you can also track not only the account status, but also the status of consideration of applications for pension savings payments, change your details, make forecasts of your pension, etc.
To receive general advice on the pension system, there is a single call center at the toll-free number 1418.
What payments exist in the UAPF, and who is entitled to them?
Persons who have reached retirement age have the right to pension payments from the UAPF at the expense of mandatory pension contributions and occupational pension contributions according to the established schedule: men - upon reaching 63 years, women this year – upon reaching 60 and a half years, in 2023 - 61 years.
The second category of recipients are persons with disabilities of the first and second groups, if the disability is established indefinitely.
To assign an old-age pension and a state basic pension, as well as to receive payments from mandatory pension contributions and mandatory occupational pension contributions from the UAPF, it is necessary to apply with a single application and a package of documents only to the Public Service Center of the State Corporation "Government for Citizens". The recipient will be provided with a proactive, that is, by default, service for the payment of the state guarantee.
To make pension payments from the UAPF to persons with disabilities of the first and second groups, if the disability is established indefinitely, it is necessary to contact the UAPF – directly to the office or through the website in the section "Electronic services".
The list of necessary documents for receiving pension payments is detailed on the website enpf.kz .
At the same time , the day of applying for a pension payment is considered to be:
- for recipients who have reached retirement age – the day of registration of the application with the State Corporation;
- for recipients with disabilities of the first and second groups, if the disability is established indefinitely – the date of receipt or receipt of documents in the UAPF.
Upon reaching the age of 45 by the depositor, with the sufficiency of pension savings of at least 70 percent of the subsistence minimum established by the law on the republican budget and effective on January 1 of the corresponding financial year, it is possible to transfer their savings to an insurance company by concluding a pension annuity agreement.
In addition, foreigners and stateless persons who have left for permanent residence outside the Republic of Kazakhstan, who have submitted documents determined by the legislation of the Republic of Kazakhstan confirming the fact of departure, have the right to pay pension savings. In order to receive payments in connection with departure for permanent residence, it is necessary to go through the procedure of registration of departure in accordance with the established procedure in the migration police authorities, obtain citizenship of another state, and then provide the necessary package of documents to the Fund.
In the event of the death of a pensioner or a person who has pension savings in the UAPF and has not reached retirement age, the savings are inherited in accordance with the procedure established by law. Also, the person who carried out the burial of the deceased, the UAPF pays a one-time payment for burial within 52 MCI. Today it is 166 thousand 632 tenge.
My mother received an SMS message with the text that she has savings in the UAPF. What's it? After all, she's been retired for five years? Is this not a "divorce"?
The UAPF, together with the State Corporation "Government for Citizens", annually performs an annual reconciliation for persons who have reached retirement age and have pension savings in the UAPF.
In the process of reconciliation, the specialists of the UAPF notify persons who have reached retirement age and receive a pension from the state budget about the need to apply for pension payments from the UAPF.
Let's explain why this happens: to assign an old-age pension and a state basic pension, as well as to receive payments from mandatory pension contributions and mandatory occupational pension contributions from the UAPF, citizens need to apply with a single application and a package of documents only to the Public Service Center of the State Corporation "Government for Citizens".
However, until 2018, when, in all likelihood, your mother retired, there was no such service: upon reaching retirement age, citizens submitted documents separately to the State Corporation for receiving a basic pension and an old-age pension and separately to the UAPF for receiving payments from pension savings. Some citizens who applied to the State Corporation and started receiving state payments did not apply for payments to the UAPF.
It is for such non-applicants that work is being carried out to assign pension payments from the UAPF by sending an SMS message from the unified number of the State Corporation 1414 to the phone number registered in the database of mobile citizens. It is enough for those who have received such messages to send a reply message, no other additional appeals and submission of documents to the UAPF or PSC are required.
Further, payments from the UAPF, together with age-related pension payments, are credited to bank accounts that were previously provided to the State Corporation when assigning the state basic pension payment.
At the same time, the amount and term of pension payments from the UAPF depend on the balance of pension savings in the recipient's individual pension account.
My friend works "in the gray", without deducting pension contributions, says that there is no guarantee that we will receive our pension savings? I would like to object to him, please formulate how it sounds in the law.
Kazakhstan is the only country in the world where there is a state guarantee of the safety of pension savings of citizens, taking into account the inflation rate at the time of retirement.
The Law "On Pension Provision in the Republic of Kazakhstan" (Article 5) guarantees recipients the safety of mandatory pension contributions and mandatory occupational pension contributions to the UAPF in the amount of contributions actually made, taking into account the inflation rate at the time of obtaining the right to pension payments.
In other words, when a person retires, the profitability is calculated on his individual pension account in relation to the inflation rate for the entire period of being in the accumulative pension system. If the profitability of pension savings during this time is below the inflation rate, the state compensates for this difference.
