Algorithm for transferring confiscated property to the balance sheets of law enforcement and special state bodies (hereinafter - LESSB)
DSPP or MIO publishes on the web portal of the register of state property (hereinafter referred to as the web portal) a notice of confiscated property proposed for transfer to the balance sheet of the LESSB at least 15 calendar days before the date of opening of applications. LESSB, if there is a need for this property, submit an application through the web portal indicating the name of the property, the required quantity, the justification for the need to transfer it, and attach an electronic (scanned) copy of the conclusion of the authorized body of the relevant industry, which indicates the criteria for the economic feasibility of transferring property:
- need within the limits of natural norms of property status;
- targeted use of property and availability of production needs;
- financial security for maintenance and operation of property.
Upon the date and time of the end of acceptance of applications, the web portal automatically opens them.
Applications and documents attached to them are considered by the DSPP or IIO commission for their compliance with the above criteria, and a decision drawn up by the protocol is made on them by the DSPP or IIO commission.
If there are several applications, the priority is taken by the LESSB, which submitted the application first, provided that the above criteria are met. If surplus property remains after meeting its needs, then it is offered to subsequent applicants.
In case of a positive decision of the commission, within 15 working days, the CSPP/DSPP or MIO makes a decision on securing/transferring the property to the balance of the LESSB, after which it is transferred under the acceptance certificate within 10 calendar days.
In case of failure to submit applications to the LESSB or the economic inexpediency of transferring property to state ownership, the property is put up for auction.
