Rules for the provision of public services "Issuance of a decision to change the purpose of a land plot"
The state service is provided by the local executive bodies of the regions, the cities of Astana, Almaty and Shymkent, districts, cities of regional significance, the akim of the city of district significance, settlement, village, rural district at the location of the land plot (hereinafter referred to as the service provider) to individuals or legal entities (hereinafter referred to as the service recipient).
Methods of providing public services:
1) e-government web portal www.egov.kz (hereinafter referred to as the portal);
2) The State Corporation "Government for Citizens".
The term of the provision of public services:
1) in case of a change in the purpose of a land plot located within the boundaries of a settlement – within up to 13 (thirteen) working days;
2) in case of a change in the purpose of the land plot located outside the settlement – within up to 16 (sixteen) working days.
The specified deadlines do not include deadlines:
conclusion of a contract for the purchase and sale of a land plot or temporary (short-term, long-term) paid (gratuitous) land use (lease) of a land plot.
The form of public service provision: Electronic (partially automated)/paper.
The result of the provision of public services: The decision of the service provider to change the purpose of the land plot with the attachment of a contract for the purchase and sale of a land plot or temporary (short-term, long-term) paid (gratuitous) land use (lease) (in case of purchase of a land plot), or a reasoned refusal to provide public services.
The amount of payment charged to the service recipient for the provision of public services, and the methods of its collection in cases provided for by the legislation of the Republic of Kazakhstan: free of charge.
The work schedule of the service provider and information objects:
1) The State Corporation "Government for Citizens" – in accordance with the work schedule of public service centers, with the exception of Sundays and holidays in accordance with the labor legislation of the Republic of Kazakhstan;
2) the service provider – from Monday to Friday in accordance with the established work schedule from 9-00 to 18-30 hours, with a lunch break from 13-00 to 14-30 hours, except weekends and holidays in accordance with the labor legislation of the Republic of Kazakhstan;
3) the portal is open around the clock, except for technical breaks in connection with repair work (when the service recipient applies after the end of working hours, on weekends and holidays, according to the labor legislation of the Republic of Kazakhstan, the application is accepted and the result of the provision of public services is issued on the next working day).
The list of documents and information required from the service recipient for the provision of public services:
1) an application for changing the purpose of a land plot in accordance with Appendix 2 to the Rules of the state service "Issuance of a decision to change the purpose of a land plot" (hereinafter – the Rules);
2) in case of a positive decision of the land commission (in case of a change in the purpose of the land plot located outside the settlement) or a positive final conclusion on a change in the purpose of the land plot (in case of a change in the purpose of the land plot located within the settlement) within 1 (one) working day:
a copy of the act of the cadastral (estimated) value of the land plot, if its intended purpose is changed, if necessary, an amount equal to the cadastral (estimated) value of the land plot is paid to the budget, an amount equal to the difference between the cadastral (estimated) value according to paragraph 5 of Article 9 of the Land Code of the Republic of Kazakhstan (hereinafter – the Code);
3) in case of a change in the purpose of the land plot located on the airfield territory: a permit for activities that may pose a threat to the safety of aircraft flights, issued in accordance with the Rules for Issuing Permits for Activities that may pose a threat to the Safety of aircraft flights, approved by Resolution of the Government of the Republic of Kazakhstan dated May 12, 2011 No. 504.
Grounds for refusal to provide public services established by the laws of the Republic of Kazakhstan:
1) establishing the unreliability of the documents submitted by the service recipient for receiving a public service, and (or) the data (information) contained therein;
2) non-compliance of the service recipient and (or) the submitted data and information necessary for the provision of public services with the requirements established by paragraph 5 of Article 9 and paragraph 3-2 of Article 97 of the Code;
3) the negative response of the coordinating bodies to the request for approval, which is required for the provision of public services in accordance with paragraphs 3 and 4 of Article 49-1 of the Code.
