In accordance with the Law of the Republic of Kazakhstan dated 28.06.2005 No. 63 "On State benefits for families with children", a monthly state benefit is assigned and paid to the mother or father, the adoptive parent (adopter), the guardian (trustee) raising a disabled child (disabled children) (hereinafter referred to as the allowance for raising a disabled child).
In accordance with the Law of the Republic of Kazakhstan No. 39-III ZRK of 13.04.2005. "On the social protection of the disabled" a disabled child is a person under the age of eighteen who has a health disorder with a persistent disorder of the body functions caused by diseases, injuries, their consequences, defects, leading to a restriction of life activity and the need for its social protection;
The assignment of this allowance is made from the date of applying to the State Corporation at the place of residence for the entire period of the child's disability, established on the basis of the certificate of the child's disability provided.
Persons have the right to apply for the assignment of benefits to the parent of a disabled child through the web portal of the "electronic government".
At the initial determination of the disability of the child, the applicant has the right to apply for the assignment of benefits to the parent of the disabled child in the medical and social expertise unit at the place of residence.
In case of impossibility of personal appeal, the applicant has the right to authorize other persons to apply for the assignment of benefits on the basis of a power of attorney issued in accordance with the procedure established by the legislation of the Republic of Kazakhstan.
The allowance for families raising a disabled child who have adopted children, as well as children with disabilities taken under guardianship (guardianship), is assigned from the date of entry into legal force of the court decision on adoption or from the date of the decision on the establishment of guardianship (guardianship).
In the case of two or more disabled children living in a family, the allowance is assigned and paid for each disabled child.
The amount of the allowance for raising a disabled child from January 1, 2021 is 48023 tenge (1.4 of the subsistence minimum established by the law on the republican budget for the corresponding financial year).
The grounds for termination of the payment of the assigned benefits to the parents of a disabled child are as follows::
- death of a child;
- determination of the child for full state support;
- submission by the applicant of false information that led to the illegal assignment of benefits (allowances);
- deprivation or restriction of parental rights of parents, invalidation or cancellation of adoption, release or removal from the performance of their duties of guardians (trustees) in cases established by the marriage and family legislation of the Republic of Kazakhstan.
