Receiving spa treatment services for persons with disabilities

RSU "Department of the Committee of Labor and Social Protection of the Ministry of Labor and Social Protection of the Population of the Republic of Kazakhstan in the Karaganda region" explains the following regarding the receipt of sanatorium treatment services for persons with disabilities:
according to the Order of the Minister of Health and Social Development of the Republic of Kazakhstan dated 22.01.2015 No. 26 "On some issues of rehabilitation of disabled people" (hereinafter - the Order), on the basis of the rehabilitation plan, which is signed by doctors in the direction of medical and social expertise (hereinafter - ITU), the specialists of the ITU departments develop the social part of the individual rehabilitation program (hereinafter - IPR) on the need for a person with a disability in sanatorium treatment (issued on hand). Further, a person with a disability applies to the department of employment and social programs at the place of residence, provides him with his social part of the IPR, writes an application for sanatorium treatment services. On the portal of social services, a person with a disability chooses a sanatorium at will. In the future, the Department of employment and social programs will issue vouchers to the sanatorium only for a person with a disability. If a person with a disability wants to go to a sanatorium with a relative, then the registration of a permit for a relative is made at the expense of the relative himself.

PRESS RELEASE

The Department of the Committee of Labor, Social Protection and Migration in the Karaganda Region informs that on October 24, 2021, the Law of the Republic of Kazakhstan dated October 12, 2021 "On Amendments and additions to some legislative acts of the Republic of Kazakhstan on social protection of certain categories of citizens" entered into force, which regulates the norm for establishing disability groups for children from the age of seven with differentiation of disability benefits.
Disability will be established for the following periods: persons under the age of seven - 6 months, 1 year, 2 years, 5 years and up to the age of seven; persons from seven to eighteen years of age - 6 months, 1 year, 2 years, 5 years or up to the age of eighteen;
According to the Law, children under the age of 7 years old receive the state basic social disability allowance (hereinafter referred to as the GSP) in the previously assigned amount until they undergo a re-examination to establish a disability group.
For example, a disabled child will turn 7 on 12/15/2021, the category "disabled child" is set until 09/01/2024. The child came to the ITU department for re-examination after the execution of 7 years - 12/16/2021. In this case, the GSP will be retained in the previously assigned amount until the re-examination. And from 12/16/2021, the size of the GSP will be calculated in accordance with the established disability group on the commission of the ITU department on 12/16/2021.
When re-examining disabled children from seven to sixteen years of age to establish a disability group within the period for which the disability group is established, the period from the date of entry into force of the Law is counted, except in cases of circumstances affecting the disability group during this period, but not more than six months.
For example:
1). The child has a disability in the category of "disabled child" until December 01, 2025, 7 years old before October 24, 2021, but for some reason the disability group has not been established in automated mode.
A disabled child must appear for re-examination before April 24, 2022 (within 6 months from the date of the Law's entry into force) - when establishing the appropriate disability group, the period is set in accordance with the rehabilitation prognosis and potential, with the offset of the period from the date of the Law's entry into force, to recalculate the size of the GSP and GSP according to the legislation;
2). The child has a disability in the category of "disabled child" until December 01, 2025, 7 years old before October 24, 2021, but for some reason the disability group has not been established in automated mode.
A disabled child is sent for re-examination after April 25, 2022 (after 6 months from the date of entry into force of the Law) - the group and period of disability are established from the date of re-examination;
3) A child of 7 years old will turn 10 March 2022, sent for re-examination on 20 April 2022 (within 6 months from the date of entry into force of the Law) - upon re-examination and establishment of the appropriate disability group, the term is set in accordance with the rehabilitation forecast and potential, with the offset of the term from 10 March 2022 (from the date of birth);
4) A child of 7 years old will turn 10 March 2022, sent for re-examination on 25 April 2022 (after 6 months from the date of entry into force of the Law) - the group and the period of disability is established from the date of re-examination.
GSP for disabled children according to the established disability group are recalculated from the date of re-examination with an additional payment for the period from the date of entry into force of the Law.
For example, a disabled child will turn 7 on 10/15/2021, the category "disabled child" is set until 12/01/2025. In this case, the disability group in the automated mode will also be established until 01.12.2025. The size of the GSP will be recalculated from the date of entry into force of the Law, i.e. from 24.10.2021.
Taking into account the above, and in order to avoid social tension among parents of disabled children, disabled children who have reached the age of seven to sixteen years on the date of entry into force of the Law, the establishment of a disability group was carried out in automated mode by ITU departments on the basis of an expert opinion issued in absentia on the basis of data available in the ITU act(s) and an assessment of the degree of disability, for the period of disability previously established under the category of "disabled child".
Automatic identification of disability groups was carried out once after the entry into force of the order of the Minister of Labor and Social Protection of the Population of the Republic of Kazakhstan dated October 30, 2021 "On amendments and additions to the Order of the Minister of Health and Social Development of the Republic of Kazakhstan dated January 30, 2015 No. 44 "On approval of the Rules of medical and social expertise".
Thus, parents/legal representatives of disabled children who are 7 years old or older on the date of entry into force of the Law do not need to contact medical organizations and ITU departments for re-examination in order to establish a disability group.
Parents of children can receive information about the established disability group on request using an EDS and/or a one-time password through the "personal account" of the e-government web portal www.egov.kz .
If necessary, when legal representatives apply to the ITU territorial department at the place of residence (registration) for confirmation of the establishment of a disability group, in a previously issued valid disability certificate, it is necessary to make an entry about the established disability group, certify with the words "corrected to believe" and the seal of the ITU department, indicate the date of correction and sign by the head of the ITU department.
In case of disagreement with the decision made in absentia, an early re-examination of a disabled child from seven to sixteen years old is carried out in order to establish a disability group, in accordance with the Rules of Medical and Social expertise approved by Order No. 44 of the Minister of Health and Social Development of the Republic of Kazakhstan dated January 30, 2015 with the offset of the term according to the Law.
