A draft Law “On Amending Certain Legislative Acts on the State of Emergency” has been submitted for your consideration.
The bill was developed in pursuance of the Decree of the Head of State of March 16, 2020 “On measures to ensure socio-economic stability”.
The purpose of the draft Law is the possibility of taking operational measures during a state of emergency to ensure socio-economic stability.
The bill defines the mechanism for the functioning of public administration during emergencies.
For this, amendments are made to the laws "On the state of emergency" and "On legal acts."
In particular, the Law "On the state of emergency" is supplemented by the specifics of the action of certain areas of legislation during the state of emergency.
The bill includes 14 areas:
- tax, budget, customs, banking, labor, antitrust laws;
- Legislation on health, public procurement, and currency regulation;
- in the field of social protection, state property, state control and supervision;
- as well as the implementation of the country's international obligations.
Legal acts adopted during the state of emergency, in general, will be valid until the expiration of its validity.
The exception will be acts in which a different period of validity will be established.
An amendment has been proposed to the Law “On Legal Acts”, according to which the effect of a normative legal act or its individual norms may be suspended, in the case and in the manner established by the Law “On the State of Emergency”.
In general, these amendments are aimed at ensuring socio-economic stability during a state of emergency.
Adoption of the draft Law will not entail additional financial costs from the budget and negative socio-economic and (or) legal consequences.
