The draft Law is presented to your attention
“On Amendments and Additions to Some Legislative Acts of the Republic of Kazakhstan on Issues of Improving the Business Climate.”
The bill provides for amendments and additions to 6 codes and 33 laws.
The bill provides for improving access to information, transferring a number of services to electronic format, reducing procedures and measures to develop a competitive environment.
To improve access to information
It is proposed to provide access to information on the presence of title documents, encumbrances and lawsuits on real estate owned by legal entities.
Also, it is allowed to disclose information on the status of encumbrance of real estate, without indicating the personal data of the owner.
This will simplify the registration process and reduce the risks of dubious transactions in the real estate market.
It is proposed for private credit bureaus to provide access to information on consumer debts to subjects of natural monopolies.
Such information is already provided to the state credit bureau on a monthly basis today.
Converting a number of services into electronic format
It is proposed to translate the electronic marking when registering transactions on written contracts that do not require notarization.
These are transactions of sale, gift, rent and others, for which notarization is not required.
It is also proposed to provide mandatory online opening of a current account with a bank during electronic state registration of an enterprise.
At the same time, in order to simplify the procedure for connecting to power networks in the capital, cities of republican and regional significance, applications for the issuance of technical conditions are envisaged to be received electronically through the sites of natural monopolies.
It is proposed to submit the statement of claim using electronic means of communication, including e-mail and mobile communications, and in the absence of electronic information, on paper.
In order to reduce procedures, it is envisaged to introduce the principle of a “single window” for connecting business entities to power networks with a capacity below 200 kW.
It is proposed to exclude the procedure for filing a notice to the State Civil Aviation Administration and the traffic police about the start of construction and installation work on technically simple objects.
Also, it is proposed to exclude procedures for the development of design estimates and passing the examination of technically simple objects.
At the same time, three procedures are combined into one for the issue of land plots with an architectural and planning assignment, topography and technical conditions. This will reduce procedure time by 17 business days.
In general, within the framework of the bill in the direction of construction, it will be simplified from 17 to 3 procedures with a reduction in terms from 103 to 18 calendar days.
In addition, it is proposed to introduce a mechanism for resolving disputes among LLP members through an internal auction of the corresponding voting right.
Measures to develop a competitive environment
It is proposed to reduce the list of grounds for creating organizations with state participation.
In this connection, state enterprises can be created solely for the purpose of ensuring national security, introducing a state monopoly or in connection with insufficient development of competition in the commodity market, determined by the analysis.
In addition, it is proposed to establish the competence of the Government to approve the list of permitted activities for state enterprises.
Also, in case of granting exclusive rights to market entities that are not subjects of a state monopoly, a competitive procedure is provided.
In general, these measures will contribute to improving the competitive environment.
