Press release to the draft resolution of the Government of the Republic of Kazakhstan "On Amendments and Additions to the Decree of the Government of the Republic of Kazakhstan dated December 28, 2015 No. 1095" On approval of the list of activities carried out by legal entities, more than fifty percent of the shares (equity in the authorized capital) of which owned by the state and its affiliates ”
These amendments to the Decree of the Government of the Republic of Kazakhstan dated December 28, 2015 No. 1095 “On approval of the list of activities carried out by legal entities, more than fifty percent of the shares (participatory interests in the authorized capital) of which belong to the state, and by their affiliates” (hereinafter - the List ), are introduced as part of the entry into force of the new edition of the National Classifier of Economic Activities from January 1, 2020, as well as the execution of orders from the management of the Presidential Administration and the Ruler Twas the Republic of Kazakhstan:
1. Protocol instruction of the Deputy Head of the Presidential Administration on measures to improve the work of the quasi-public sector (No. 19-61-49.5 of October 25, 2019).
In accordance with the specified order, the Ministry of National Economy needs to intensify work to reduce the List
and to work out the issue of its division, taking into account the level of urban development, to minimize state participation in the capital and cities of republican significance.
As part of this work, the antimonopoly agency proposes to limit the implementation of a number of activities in the capital and cities of republican significance, due to the presence of competition in local commodity markets.
In addition, the Ministry conducted a competition analysis.
based on the results of which it was established that 42 types of economic activities carried out by national companies and holdings are advisable to be excluded from the List, due to the presence of private business entities engaged in similar activities.
2. An order from the Head of the Presidential Administration to study the issue of regulating the activities of subordinate organizations of the National Bank (No. 17-3630-2 of October 19, 2017).
According to Article 12 of the Law of the Republic of Kazakhstan “On State Property”, the management of state property assigned to the National Bank is assigned exclusively to the competence of the National Bank of the Republic of Kazakhstan.
In this regard, in order to regiment the activities of subordinate organizations of the financial regulator, it is planned to supplement the List with an appropriate section that takes into account the specifics of the activities of subordinate organizations of the National Bank.
3. The order of the Deputy Prime Minister on the study of the issue of temporary addition to the List with activities for the maintenance and repair of military aircraft (No. 16-17 / 2233 of November 10, 2019)
As part of the execution of this order, the Ministry of National Economy conducted an analysis of the commodity markets for the production, repair and maintenance of military aircraft.
According to the analysis it was found that with the exception of the subject
Kazakhstan Aviation Industry LLP (hereinafter - the Partnership)
in the Republic of Kazakhstan there are no business entities engaged in these types of work.
The partnership is a subject of the quasi-public sector with 100% participation of the state in the authorized capital. At the same time, the activities of the partnership are not regulated in the List.
At the same time, it should be noted that in accordance with the Decree of the Government dated December 30, 2015 No. 1141 “On Some Issues of Privatization for 2016-2020,” the Partnership is on the list of legal entities subject to privatization.
In July 2018, JSC “NC“ Kazakhstan Engineering ”and LLP“ Kamkor Management ”entered into an agreement on the sale of a 50% stake in the charter capital of the Partnership, which will enter into force in 2020.
In view of the foregoing, in order to regulate the activities of the Partnership, it is proposed to temporarily supplement List 3 of the OKED:
- 30301 “Production of airborne aircraft”;
- 33160 “Repair and maintenance of air and spacecraft”;
- 46140 "Activities of agents in the wholesale trade of machinery, equipment, ships and aircraft."
