On the state of labor relations in the West Kazakhstan region
State control over compliance with labor legislation.
In 2020, 454 complaints were received regarding violations and clarification of labor legislation, 428 of them from individuals and 26 from legal entities.
State labor inspectors checked 51 enterprises and organizations on the basis of received requests from citizens, as well as on the requirements of law enforcement and state bodies.
During the inspection identified 57 violations, including: labour relations – 54; safety and health – 3; employment of the population – 0.
According to the revealed violations, 38 orders were issued and 11 fines were imposed in the amount of 1.479 million tenge and 1 warning.
It should be noted that by decree of the President of the Republic of Kazakhstan dated December 26, 2019 No. 229, the Central state and local Executive bodies decided to stop inspections and preventive control and supervision with visits to small businesses, including microenterprises, from January 1, 2020 to January 1, 2023 (effective from the date of its first official publication).
This moratorium also applies to inspections (unscheduled inspections) carried out by the state labor Inspectorate on employees ' requests in the activities of employers.
Thus, if the employer is a micro or small business entity, it is not possible to conduct an unscheduled check in relation to this employer, based on the facts of citizens ' appeals.
To protect their labor rights, a citizen can apply to the court in civil proceedings.
