Labor risk map and wage arrears

Issues related to the protection of citizens ' labor rights are under special control of local Executive bodies.
Work in this direction is carried out in accordance with the Joint order of state bodies "on measures for interaction in the field of protection of labor rights of citizens, collection of wage arrears and the procedure for exchanging information" by adopting a set of coordinated measures by Central and local Executive bodies to identify and eliminate violations of the law and to promptly exchange information.
On an ongoing basis, the monitoring of social tension and the risks of labor conflicts.
According to the results of monitoring, problematic issues of social and labor relations are constantly considered at meetings of the anti-Crisis headquarters, trilateral commissions on social partnership and regulation of social and labor relations.
Also, measures to prevent and resolve social tensions and risks of labor conflicts are carried out within the framework of the "Algorithm for taking measures to prevent and resolve labor conflicts".
The increase in the incidence of Covid-19 and strict restrictive measures to prevent It had a negative impact on the economic situation of many enterprises in the region, as a result of which there was a decline in business activity, severed production ties, reduced demand for manufactured products, services, etc.
In this regard, employers have taken unpopular optimization measures that limit the amount of social support for their employees.
The combination of these conditions creates prerequisites for the growth of social tension in the teams:
Therefore, the issues on prevention of social conflicts at the facilities of the Karachaganak and Chinarevskoye oil and gas condensate fields, as well as issues by key operators "KPO b.in." and LLP "Zhaikmunai" 4, 14, 20 August and 11 September 2020 was considered at the meetings of the tripartite commissions for social partnership and regulation of social and labor relations in Burlin region, Uralsk city and the regional Commission.
Also, in order to prevent unpopular optimization measures of the employer, the labor Inspectorate, together with other state bodies, developed an "action Plan to reduce hotbeds of tension and protest in business entities most affected by the spread of Covid-19", which covers the following activities:
- Collecting information on the state of large and medium-sized businesses that are most affected by the spread of "Covid-19»;
- Carrying out a comprehensive analysis of the measures taken by employers to prevent the spread of KVI and the prerequisites for having a negative impact on the social well-being of labor collectives
- Immediate response and adoption of measures to protect the labor rights of employees (non-payment of wages, illegal dismissal, forcing employees to submit leave without pay).
- Conducting explanatory work with employers to preserve jobs with the maximum use of existing mechanisms provided for by labor legislation (introduction of part-time work at enterprises, temporary transfer to another job, secondment to other legal entities, etc.);
- etc.
According to the Monitoring of social tension and risks of labor conflicts, today the debt amounts to 80.853 million tenge in 8 enterprises to 336 employees.
Including in 6 enterprises that are bankrupt and rehabilitated, the debt amounts to 79.472 million tenge to 333 employees.
And also, in 2 enterprises for which enforcement proceedings were initiated (initiated by private bailiffs), the debt is 1,381 million tenge to 3 employees.
The analysis showed that most of the debt in enterprises occurs as a result of the lack of work volumes and the market for products, which is a consequence of poor management and the lack of orientation of the enterprise to market needs.
In these enterprises, within the framework of the current legislation, all necessary measures are taken to repay salary arrears.
In 2020, using the existing mechanisms within the framework of the AKSH, the trilateral Commission and the Joint plan, the repayment of salary arrears in the amount of more than 45.248 million tenge was provided, which allowed protecting the rights of 398 employees.
In order to prevent social and labor conflicts, the state labor Inspectorate, together with employers and trade unions, regularly conducts explanatory and consulting work on the basics of labor legislation.
Based on the recommendation of the Ministry of labor and social protection of the population of the Republic of Kazakhstan, explanatory notes were developed and sent out "Features of labor activity during the period of measures for the prevention of coronavirus infection".
During the state of emergency, labor inspectors in the Call center under the mayor's office of Uralsk conducted daily explanatory work on the specifics of labor relations during the period of restrictive measures.
Also, at the territorial Union of trade unions " Trade Union center of WKO "in March 2020, a working group of negotiators was created and operates, which included representatives of the trade Union center of WKO, the WKO branch of the Nur Otan party and the labor Inspectorate of WKO.
The management of the Department of labor inspection of the West Kazakhstan region spoke 5 times in live broadcasts and press conferences on television channels, on the main issues of labor relations during the quarantine period.
In General, to date, employees of the labor Inspectorate have held 19 meetings in labor collectives to explain the basics of labor legislation, covering 641 employees and representatives of employers.
In order to provide information support, 16 times labor inspectors conducted explanatory work on the most popular socially significant issues through the territorial media.
