According to the Decree of the President of the Republic of Kazakhstan dated October 21, 2020 No. 439 "On the appointment of the next elections of deputies of the Mazhilis of the Parliament of the Republic of Kazakhstan", the next elections of the Mazhilis of the Parliament of the Republic of Kazakhstan are scheduled for January 10, 2021.
The constitutional term of office of the Mazhilis deputies elected on March 20, 2016, expires in March 2021.
According to the electoral legislation, regular elections of deputies of the Mazhilis are appointed by the President at least five months in advance and are held no later than 2 months before the end of the term of office of deputies of the Mazhilis.
The campaign for the election of deputies of the Mazhilis of Parliament has been appointed in strict accordance with the indicated constitutional terms and is yet another one.
The Central Election Commission, in accordance with the established powers, organizes the preparation and conduct of elections of the President and deputies of the Mazhilis of the Parliament of the Republic of Kazakhstan.
In this regard, on the basis of the norms of the current legislation, a calendar plan of the main measures for the preparation and conduct of elections of deputies of the Mazhilis of the Parliament of the Republic of Kazakhstan, elected by party lists, was approved.
A candidate for deputy of the Mazhilis of Parliament may be a citizen of the Republic of Kazakhstan who has lived in its territory for the last 10 years, who has reached 25 years of age and has a passive electoral right.
Cannot be a candidate for deputies of the Parliament of the Republic of Kazakhstan, including on party lists:
1) a person who has a criminal record that has not been canceled or canceled in the manner prescribed by law;
2) a person whose guilt in the commission of a corruption offense and corruption offense has been recognized by a court in accordance with the procedure established by law.
The right to nominate candidates for deputies of the Mazhilis, elected according to party lists, belongs to political parties registered in the prescribed manner.
When approving party lists, a political party includes women and persons under the age of twenty-nine, in the amount of at least thirty percent of the total number of persons included in it.
In accordance with the approved plan, the stage of nomination of candidates begins two months and ends at eighteen o'clock local time forty days before voting day. That is, from November 10 to 6 p.m. on November 30 this year.
Registration of party lists begins two months before and ends at 18:00 local time one month before the elections, that is, from November 10 to 6 p.m. on December 10, 2020.
In accordance with paragraph 2 of Article 27 of the CL, election campaigning begins from the moment the registration period for party lists expires and ends at zero hours local time on the day preceding election day.
Thus, the total duration of the regular elections of deputies of the Mazhilis of Parliament, elected by party lists, from the day of appointment to the day of voting will be 82 days.
The Constitutional Law of the Republic of Kazakhstan "On Elections in the Republic of Kazakhstan" provides for the powers of the Central Election Commission to appoint regular elections of maslikhats.
Regular elections of deputies of maslikhats of all levels are held simultaneously and cannot coincide in terms with the elections of the President, deputies of the Senate of the Parliament.
In this regard, by the Decree of the Central Election Commission of the Republic of Kazakhstan dated October 21, 2020 No. 21/323 "On the appointment of the next elections of maslikhats of the Republic of Kazakhstan", the next elections of deputies of maslikhats are scheduled for January 10, 2021.
The Central Election Commission, in accordance with its competence, by decree of September 11, 2020 No. 21/323, in accordance with the size of the population of administrative - territorial units, determined the number of maslikhat deputies elected from them.
In the upcoming campaign, 141 deputies of 9 maslikhats in Atyrau region are to be elected. Of these: 31 deputies of the regional maslikhat, 24 deputies of the Atyrau city maslikhat, 86 deputies in 7 maslikhats of regions.
The upcoming election campaign for elections of deputies of maslikhats has a number of features:
First, for the first time, elections to maslikhat are held according to party lists of political parties.
Secondly, in accordance with the amendments to the Constitutional Law on Elections, a single territorial constituency is formed on the territory of the corresponding administrative-territorial unit during the election of deputies to maslikhats.
Thirdly, the number of women and persons under the age of twenty-nine must be at least thirty percent of the total number of persons included in the party list.
A citizen of the Republic of Kazakhstan who has reached twenty years of age may be elected as a deputy of the maslikhat. A citizen of the Republic can be a deputy of only one maslikhat. The candidate must have a passive electoral right. That is, citizens who have been declared legally incompetent by the court, as well as those who are in places of imprisonment by a court verdict, do not have the right to be elected.
Territorial election commissions are responsible for holding elections of deputies to maslikhats.
In this regard, a standard calendar plan of the main activities for the preparation and conduct of elections of deputies of maslikhats of the Republic of Kazakhstan was adopted. On the basis of which each territorial commission will adopt Calendar plans within two days.
In accordance with it, the stage of nominating candidates for deputies will last from November 10, 2020 until 6 p.m. local time on December 4, 2020.
Registration of candidates for deputies of maslikhats ends at 18:00 local time on December 10, 2020.
The election campaign will begin after 18:00 local time on December 10, 2020, and end at zero hours local time on January 9, 2021.
The results of elections of deputies of maslikhats are established by the corresponding territorial election commission no later than five days from the date of the elections.
Registration of the elected deputies of maslikhats is carried out by the corresponding territorial election commission.
In the Atyrau region, 9 territorial, 265 precinct election commissions have been formed, of which 11 are closed (hospitals, a place of temporary detention, a military unit), 1,988 commission members work in them.
As of October 1, 2020, 409,133 voters are registered in the region. At this time, work is underway to clarify the lists of voters.
According to the Timetable, twenty days before the start of voting, i.e. by December 21, 2020, the relevant akims submit to the precinct election commission signed voter lists for each polling station.
A message on the composition and location of election commissions, the boundaries of polling stations will be published in regional newspapers and the Internet resource of the regional akimat atyrau.gov.kz until October 31, 2020.
