This Law regulates the legal, organizational and economic basis of state management of highways in the Republic of Kazakhstan, their construction, operation and development in the interests of the state and users of highways.
Chapter 1. General provisions
Article 1. Basic concepts used in this Law
The following basic concepts are used in this Law:
1) national operator for road management (hereinafter referred to as the national operator) – a joint-stock company with one hundred percent participation of the state in the authorized capital, exercising the powers established by this Law;
1-1) road managers – individuals and legal entities that are owners of roads or carry out activities for the management of roads on the right of economic management or operational management, on the basis of contracts within the framework of the state task, public-private partnership agreements, including concession agreements, trust management of property, gratuitous use of public roads of regional or district significance or their sections;
2) road users - individuals and legal entities who are road users or carry out other activities within the right-of-way of highways and roadside lanes;
3) automobile road - a complex of engineering structures intended for the movement of cars, providing continuous, safe movement of cars and other vehicles with established speeds, loads, dimensions, as well as land plots provided for the placement of this complex (transport land), and the airspace above them within the established size;
4) current repair of a highway - a set of works performed in order to prevent the occurrence of accidents, defects on highways, as well as urgent restoration and repair of a highway, carried out throughout the year, including measures to repair destroyed sections performed by a route method;
5) repair of a road - a set of works on prevention and elimination of defects, as well as restoration and improvement of transport and operational qualities of a road, including current, medium and major repairs;
6) major repair of a highway - a set of works to restore and (or) improve the transport and operational characteristics of a highway without changing the existing technical category;
7) maintenance of the highway - a set of works to maintain the proper technical condition of the highway, assess its technical condition, as well as to organize and ensure road safety;
8) medium road repair - a set of works related to the restoration of the original operational qualities of the road and road structures;
9) reconstruction of a highway - a set of works that provide an increase in transport and operational qualities, safety and convenience of movement with the transfer of a highway or a separate section of it to a higher technical category;
9-1) section of a highway (hereinafter referred to as a section) – a segment of a highway located within the boundaries of its total length;
10) the length of the highway - the actual length of the road between objects or localities, indicated in kind (on the ground) by kilometer signs;
11) toll roads (sections) – roads (sections) in respect of which a decision has been made to use them on a paid basis and for which a fee is charged;
11-1) organization of toll traffic – measures to collect tolls on toll roads (sections) through the introduction and installation of software and hardware complexes for collecting tolls, as well as management of a toll road;
12) heavy-duty vehicle - a vehicle with or without a load, the total weight or load distribution along the axes of which exceeds the maximum permissible loads for this category of roads and structures on them;
13) large-sized vehicle - a vehicle with or without cargo that exceeds the overall dimensions established by regulatory legal acts;
13-1) road assets – roads and structures on them, taking into account their actual transport and operational condition and cost assessment;
13-2) road asset management – activities for the diagnosis and instrumental examination of road assets, as well as monitoring the safety of road infrastructure, aimed at effective planning of budget expenditures for the repair and maintenance of highways;
13-3) national road asset quality center – a legal entity that is under the jurisdiction of the authorized state body for highways, which is entrusted with the functions of conducting an expert examination of the quality of works and materials during the construction, reconstruction, repair and maintenance of highways, managing road assets, organizing mobilization training on highways of international and national significance, as well as conducting departmental expertise of technical documentation for the average repair of public roads, introducing new technologies and supporting pilot sites;
14) roadside lanes - land plots adjacent to the allotment lane of highways, within the boundaries of which special conditions for the use of land are established to ensure the safety of traffic and the population;
14-1) roadside service facilities – buildings and structures (motels, hotels, campsites, service stations, gas stations, food, trade, communication, medical care, outdoor (visual) advertising and other service facilities) located on the roadside and intended for servicing road users on the way;
15) right-of-way - transport lands occupied by highways, for placement of the corresponding structural elements and engineering structures of the highway, as well as buildings, structures, protective and decorative forest plantations and road communication devices necessary for their operation;
15-1) road database – an information system of the authorized state body for highways, open to road users, containing information on the transport and operational condition of highways;
15-2) monitoring of road infrastructure safety – a set of measures aimed at ensuring the safe functioning, maintenance and improvement of the existing road infrastructure of public roads of international and national significance in accordance with the legislation of the Republic of Kazakhstan;
16) road activities – activities related to the design, construction, reconstruction and repair, maintenance and use of highways and structures on them, management of road assets, as well as the organization of toll traffic;
17) road management - a set of measures aimed at organizing and ensuring the safety and convenience of traffic on roads, improving the transport and operational condition of highways and structures, ensuring the order of their protection, organizing the design, construction, reconstruction, repair, maintenance and use of highways based on national standards and the introduction of advanced technologies;
18) objects of the road service – road maintenance complexes, residential buildings for employees of the maintenance service, bus stops, pavilions, recreation areas, areas for short-term stopping of cars, devices for technical inspection of cars, structures and devices designed to ensure road safety, forest belts, service points and protection of bridges, technological and emergency call communication devices, software and hardware complex for charging tolls;
19) road authority – an authorized state body for highways that manages state public roads;
20) excluded by the Law of the Republic of Kazakhstan dated 19.04.2019 No. 249-VI (entered into force after ten calendar days after the date of its first official publication);
20-1) software and hardware complex of toll collection – a set of equipment, software and road elements intended for toll collection;
21) street (roadway) - a road within the borders of localities.
22) is excluded by the Law of the Republic of Kazakhstan dated 05.10.2018 No. 184-VI (entered into force after ten calendar days after the date of its first official publication).
