Since the beginning of 2020, 18 accidents have occurred in various companies and organizations in Atyrau region. In such situations, mandatory insurance payments are provided.
According to the Department of the State Labor Inspectorate of Atyrau region, a number of accidents at work were recorded that year. In particular, in Ariadna LLP, an assembler of steel structures was seriously injured when installing metal pipes on an earthen embankment. When determining the degree of guilt, it was found that the employer's fault is 80 percent, and the degree of guilt of the victim himself is 20 percent.
In JSC "Kazpost", while at the workplace, a window adapted for receiving and issuing parcels fell on the operator of GOPS-8. The man suffered a severe head injury. In this case, the employer is guilty.
In "Beket Sat Zhol" LLP, a worker who received a head injury was killed. In this accident, the degree of fault of the employer was 60 percent. Head of safety control and labour protection Department of the state labour Inspectorate of Atyrau region Raw Dzhabasov explained that compulsory insurance of employees against accidents in the performance of their duties is carried out by the employer on the basis of article 182 of the Labour code of the Republic of Kazakhstan.
- Employee accident insurance is one of the duties of the employer, an important element of social protection of employees from occupational risks, which guarantees insurance payments to victims due to
the accident, reported Raw Dzhabasov. – The main purpose of occupational accident insurance is to provide a certain level of income to employees and their families in the event of disability or disability by the relevant authorities. Compensation for damage related to the establishment of the employee's degree of loss of professional ability to work from 5 to 29% is carried out by the employer. If the amount of the established degree is from 30 -100%, then this insurance payment is made by the insurance company.
When the occupational disability and death of the worker on production in the accident the insurer is the insurance benefit in connection with the assignment of the degree of incapacity in the form of payments for the period equal to the period of the establishment or its renewal in accordance with the contract, but not more than the period of the employee's retirement age. Also, in case of loss of professional ability to work, the insurer reimburses additional expenses caused by damage to the employee's health, on the basis of documents confirming these expenses.
- The total amount of insurance payments for reimbursement of additional expenses may not exceed the following amounts in monthly calculation indices established by the Law on the Republican Budget. When determining the degree of loss of professional ability to work from thirty to fifty-nine percent inclusive-500 MCI, from sixty to eighty-nine percent inclusive-750 MCI, from ninety to one hundred percent inclusive-1000 MCI, - S. Jabasov informed. – In case of death of the employee in favor of the persons having according to the legislation of Kazakhstan the right to compensation of damages is insurance payment for damages associated with the death of an employee in case of an accident. Also, due to the deterioration of his health as a result of an accident, compensation is made in the form of payments within the period established by the Civil Code of the Republic of Kazakhstan. In the event of the death of the injured employee, the person who carried out his burial is reimbursed by the insurance company for the cost of burial in the amount of 100 MCI.
