The analysis of citizens ' appeals received by the Department of the State Labor Inspectorate of Atyrau region shows that mostly citizens apply for violations of labor legislation related to late payment of wages and compensation.

There is no doubt that the completeness and timeliness of payment of wages is one of the foundations of the stability of each family.

It should be noted here that the Constitution and the Labor Code of the Republic of Kazakhstan enshrine the right of everyone to freedom of work and remuneration for work, without any discrimination, and therefore, in cases of appeals from citizens and during preventive control, issues of remuneration are subject to thorough verification by state labor inspectors.

In accordance with article 113 of the Labor Code of the Republic of Kazakhstan, wages are established and paid in cash in the national currency of the Republic of Kazakhstan at least once a month no later than the first decade of the next month. The date of payment of wages is provided for in labor and collective agreements. If the day of payment of wages coincides with weekends or holidays, payment is made on the eve of them. When paying wages, the employer is obliged to notify each employee in writing or electronically on a monthly basis about the components of the salary due to him for the relevant period, the amount and grounds for deductions made, including information about the withheld and listed mandatory pension contributions, as well as the total amount of money to be paid. Upon termination of the employment contract, payment of the amounts due to the employee from the employer is made no later than three working days after its termination.

In the past period of this year, labor inspectors considered 968 appeals of citizens and, as a result, protected the labor rights of 403 employees of enterprises and organizations of the region.

For all identified facts of non-timely payment of wages by state labor inspectors, mandatory instructions on the elimination of violations are made to employers.

For late payment of wages against 25 employers, 25 cases of administrative offenses were initiated under Article 87 of the Code of the Republic of Kazakhstan on Administrative Offenses, with the imposition of an administrative penalty in the form of a fine totaling 4.7 million tenge.

In total, in the period from 2018 to the present, employers have paid 182. 4 million tenge of salary arrears by the measures of the labor inspectorate's response.

For example, this year "Atyrau Oil and Gas Company" LLP had a salary arrears for the month of June to 327 employees totaling 56.1 million tenge, to eliminate which, the labor inspectorate made an order, according to the results of consideration of which the debt was repaid. In addition, LLP "AtyrauNefteMash" for late payment of wages to employees was brought to administrative responsibility, with the imposition of an administrative fine.

Currently, 3 enterprises of the region have wage arrears in the amount of 6.5 million to 21 employees (Water Energi LLP - 4.7 million tenge, Kazelektrikum LLP-342,015 tenge and Catering Lider Company LLP-1.5 million tenge).

These debts were formed in the period 2017-2019 and for the repayment of which the regional labor inspectorate issued instructions, and the heads of companies were brought to administrative responsibility.

Together with the authorized state and law enforcement agencies, work is being carried out to repay wage arrears and restore the rights of employees, as a result of which the labor inspectorate transferred materials to the prosecutor's office and criminal cases were initiated against the heads of 2 companies under part 3 of Article 152 of the Criminal Code of the Republic of Kazakhstan.

Work on debt repayment continues.

In order to prevent violations of labor legislation, the State Labor Inspectorate constantly conducts explanatory work, both with employers and with citizens of the region.
