To carry out geological, geophysical, prospecting, geodesic, soil, geobotanical, land management, archaeological, design and other survey work, you must obtain a special permit. This procedure is regulated by Article 71 of the Land Code of the Republic of Kazakhstan dated June 20, 2003.
Permits for the use of land plots for survey work, with an indication of its validity period, are issued by district and city executive bodies, and for work on arable land, improved hayfields and pastures, on lands occupied by perennial plantations, as well as on lands of specially protected natural territories and forest fund lands — by local executive bodies of regions, cities of republican significance, and the capital.
The term of rendering this state service from the date of submission of the package of documents is 10 (ten) working days.
The result of the provision of a public service is a decision to issue a permit for the use of a land plot for survey work, or a reasoned refusal to provide a public service.
The state service is provided to individuals and legal entities free of charge.
The list of documents required for the provision of public services when applying to the service recipient (or an authorized representative: a legal entity under a document confirming the authority; an individual under a notarized power of attorney):
1) application form;
2) identity document (required for identification of the individual);
3) plan (scheme) of the survey site;
4) a copy of the task for performing survey work.
It should be noted that Article 71 of the Land Code of the Republic of Kazakhstan does not apply to the conduct of survey work in the implementation of operations for the exploration of minerals and geological study. Thus, Chapter 7 of the Land Code of the Republic of Kazakhstan by the Law of the Republic of Kazakhstan dated 27.12.2017 No. 126-VI was supplemented with a new Article 71-1, according to which subsurface users who carry out operations for mineral exploration or geological study on land plots that are privately owned or land-use can carry out the necessary work on such sites on the basis of a private or public easement. The establishment of public easements by local executive bodies does not apply to public services.
