Rational use of agricultural land is one of the main aspects of the development of agriculture.
For our region, agricultural lands have a special legal status, therefore they are subject to protection aimed at their preservation, increasing fertility and rational and efficient use.
According to the current legislation, land owners and land users are obliged to use the land in accordance with its intended purpose (paragraph 1, paragraph 1, Article 65 of the Land Code of the Republic of Kazakhstan).
Cases of non - use of land include:
on arable land – failure to carry out work on the processing of land for crops;
on haymaking – non-haymaking on the land plot, the presence of overgrowth with weeds, shrubs, small woodlands and other signs of degradation of the herbage;
on pastures –the absence of farm animals for grazing or their presence in an amount of less than twenty percent of the maximum permissible load on the total area of pastures established by the authorized body in the field of development of the agro-industrial complex, and (or) the absence of haymaking for the purpose of forage harvesting (paragraph 4 of Article 92 of the Land Code of the Republic of Kazakhstan).
In case of non-use of the provided lands, the legislation provides for a number of sanctions, namely:
1) conducting an inspection and imposing a fine from 10 to 200 MCI in accordance with Article 338 of the Administrative Code of the Republic of Kazakhstan, calculating the base rate of land tax increased by 20 times (Article 509 of the Tax Code of the Republic of Kazakhstan);
2) encumbrance on a land plot (Article 94 of the Land Code of the Republic of Kazakhstan);
3) compulsory seizure of a land plot in case of non-elimination of violations identified as a result of inspections;
4) entering a land user into the register of persons from whom land plots have been forcibly withdrawn, which leads to a ban on obtaining any land plots in the territory of the Republic of Kazakhstan in the next 3 years, regardless of the intended purpose (Article 96-1 of the Land Code of the Republic of Kazakhstan).
Today, the Government of the Republic of Kazakhstan pays special attention to the application of remote sensing data and the involvement of agricultural land in circulation.
Currently, work is underway in the Akmola region to monitor the use of agricultural land using information technology.
Also, an interdepartmental subgroup on the seizure of unused and issued agricultural land in violation of the legislation operates in the territory of Akmola region.
Based on the above, we urge all agricultural producers to use land plots in accordance with their intended purpose.
