According to the Law of the Republic of Kazakhstan "On Amendments and Additions to Some Legislative Acts of the Republic of Kazakhstan on the digitalization of Public services in the Field of Land relations" (hereinafter - the Law) dated April 5, 2023, the following amendments were made to the land legislation, which came into effect on July 1, 2023.
In accordance with the above Law, the institution of the land commission in cities of regional and district significance has been excluded and an electronic procedure for the provision of land plots has been introduced (new Article 44-2 of the CC RK).
On the basis of Article 44-2 of the Land Code of the Republic of Kazakhstan, individuals and legal entities interested in obtaining the right to a land plot, through the e-government web portal or through a State Corporation, submit an application with an independent formation on the public cadastral map of the allotment scheme of the requested land plot.
Attached to the application are:
- scheme of allotment of land;
- other documents related to the provision of land plots specified in paragraph 1 of Article 48 of this Code.
The total term of consideration of the application for granting the right to a land plot is up to thirty working days from the date of receipt of the application.
The above – mentioned Law introduced the following new concepts:
public cadastral map - a digital map that contains information (information) from the land, legal and urban planning cadastres of the Republic of Kazakhstan, as well as other information of state bodies and (or) organizations in accordance with the legislation of the Republic of Kazakhstan.
The information system of the unified state cadastre of real estate is an information system containing information of land and legal cadastres, the procedure for maintaining which is determined by this Code and the Law of the Republic of Kazakhstan "On State Registration of Rights to immovable Property".
cadastral passport of a real estate object is an identification document containing technical, identification characteristics of a primary or secondary real estate object, as well as identification characteristics of a land plot located in cities of republican significance, the capital, cities of regional and district significance, according to the form approved by the state body carrying out state regulation and control of activities in the field of state registration of rights to immovable property property and state technical inspection of immovable property.
In connection with the above, in order to obtain a land plot in cities of regional (district) significance, each individual or legal entity has the right to submit an application with an independent choice of a land plot by drawing its boundaries on a public cadastral map.
