UAPF JSC (hereinafter - UAPF) informs about the procedure for taxation of a lump-sum benefit payment for burial, made from the pension savings of a deceased person.
In accordance with paragraph 3 of Article 242 of the Social Code of the Republic of Kazakhstan dated April 20, 2023 No. 224-VII ZRK, in the event of the death of a person who has pension savings in the UAPF, his family members of the UAPF are made a lump-sum benefit payment for burial at the expense of the pension savings of the deceased person within an amount in the amount of 94 times the monthly calculation index (MCI) established for the corresponding financial year by the law on the republican budget, but not more than the funds of the deceased person available on the individual pension account. This lump sum payment is not subject to personal income tax.
If, after making a lump-sum benefit payment for burial, the balance of pension savings on the individual pension saving account of the deceased person amounts to an amount not exceeding the minimum pension established for the corresponding financial year by the law on the republican budget, this balance is also paid to the family members of the deceased along with a lump-sum benefit payment for burial.
At the same time, since, according to subparagraph 18) of paragraph 1 of Article 341 of the Code of the Republic of Kazakhstan On taxes and other obligatory payments to the budget, benefit payments for burial within the amount of 94 times the MCI are excluded from the income of an individual subject to taxation within the amount of 94 times the MCI, the amount of the balance of pension savings on the individual pension saving account of the deceased person, upon payment, it is subject to taxation at the standard rate of 10 percent of individual income tax.
From July 1, 2023, in accordance with the adopted Social Code of the Republic of Kazakhstan, one lump sum pension benefits for housing and medical treatment will be made from pension savings formed only from compulsory pension contributions (CPC).
From the same date, CPC contributors who are beneficiaries of seniority pensions (i.e. former military personnel and equivalent retirees) will also be eligible for lump sum pension benefits for housing improvement and/or medical treatment.
On July 1, 2023, the Social Code of the Republic of Kazakhstan came into force, which provides for a number of innovations, including those relating to the conditions for benefit payments to the family for burial from the pension savings of the deceased person.
According to paragraph 3 of Article 242 of the Social Code, in the event of the death of a person who has pension savings in the UAPF, the members of his family of the UAPF are made a one-time payment for burial at the expense of the pension savings of the deceased person within the amount of 94 times the monthly calculation index (hereinafter - MCI) established for the corresponding financial year by the law on the republican budget, but not more than the funds of the deceased person available on the individual pension saving account (hereinafter - IPSA).
In the event that after the lump sum payment for burial, the balance of pension savings on the IPSA of the deceased person after the lump sum payment for funeral is an amount not exceeding the minimum pension established for the relevant financial year by the law on the republican budget, this balance is also paid for burial to family members deceased along with a one-time payment for burial.
Recall that earlier the Law of the Republic of Kazakhstan On Pension Provision in the Republic of Kazakhstan, which became invalid from July 1, 2023, provided that an application for a one-time payment for burial could also be submitted by persons who carried out the burial, and the payment amounted to an amount equal to 52.4 times MCI.
Now, from July 1, 2023, the amount of the lump-sum benefit payment for burial in the event of the death of a person who has pension savings in the UAPF has increased from 52.4 times to 94 times the MCI established for the corresponding financial year by the law on the republican budget, but not more than those available for IPSA in UAPF means the deceased person. At the same time, a one-time payment for burial from the UAPF can only be paid to family members of a deceased person who has pension savings in the UAPF.
The list of documents may vary depending on the age of the person who submits the documents. If this is a child under 14, then the documents must be submitted by his legal representative. If it is a minor from 14 to 18 years of age, the consent of his legal representative is required. In addition, the list of documents for family members of the deceased can be significantly reduced if the database of state bodies contains information about the death of the person, as well as information confirming family ties with the deceased person who has IPSA in the UAPF.
The full list of documents required for the UAPF to make lump sum payment for burial can be found on the UAPF website.
Lump-sum payments for burial from the UAPF in the event of the death of a person who has pension savings in the UAPF are made within 5 (five) business days from the date of receipt of documents by the UAPF.
If pension savings remain on the IPSA in the UAPF after the lump-sum payment for burial, then they are further inherited in the manner established by the Civil Code of the Republic of Kazakhstan.
Starting from 2021, UAPF does not charge any commission on investment income. It is charged only by pension asset managers: the National Bank of the Republic of Kazakhstan and investment portfolio managers.
According to the Social Code, which entered into force on July 1, 2023, the commission fee of the UAPF is 0.008% per month of pension assets (there was a decrease from 0.001%). Also, the amount of the commission is additionally limited - it cannot be more than the amount defined as the product of 0.04 times the monthly calculation index (MCI) established by the law on the republican budget and effective as of January 1 of the corresponding financial year and the number of individual pension saving accounts (IPSA ) contributors (beneficiaries) with pension savings according to the accounting of compulsory pension contributions (CPC) opened in the UAPF as of the 1st day of the corresponding calendar month.
The UAPF commission is used for the development of information and telecommunications services, hardware and software support, employee remuneration, postal and notification services, etc.
According to the Social Code, the NBRK has the right to charge a commission of no more than 2% of investment income. In 2023, it will be further reduced to 1.5%.
Investment Portfolio Managers (IPMs) are entitled to charge a commission on investment income not exceeding 7.5% of investment income. The actual amount of the commission is annually approved by the governing body of the IPM and can change no more than once a year. Up-to-date information on the IPM commission for 2023 is available on the enpf.kz website in the section: "Services" - "Register of Investment Portfolio Managers".
Investment income consists of income in the form of interest on securities (deposits and other transactions), market and currency revaluation of financial instruments, income on assets under external management, etc. Pension contributions received on individual pension saving accounts are invested by the trust manager of pension assets - the National Bank of the Republic of Kazakhstan (NBK) and investment portfolio managers (IPM) in reliable financial instruments of different sectors of the economy in various currencies in the Republic of Kazakhstan and abroad. Due to this diversification, the safety of assets and sustainable investment returns are ensured.
Pension assets managed by the NBRK are invested in accordance with the Investment Declaration approved by the Resolution of the Board of the NBRK dated February 24, 2020 No. 10, as well as the list of financial instruments allowed for IPM to be acquired at the expense of pension assets, in accordance with the resolution of the Board of the Agency of the Republic of Kazakhstan on Regulation and development of the financial market dated February 15, 2021 No. 29.
IPMs have their own strategies for investing pension assets within the framework of the Resolution of the Board of the Agency of the Republic of Kazakhstan for Regulation and Development of the Financial Market dated February 15, 2021 No. 29 On approval of requirements for investment portfolio managers to whom pension assets can be transferred for trust management, and independently determine the structure of the investment portfolio as part of the investment declaration. Accounting for all pension savings (even after the transfer of part of them to private management companies) is maintained by the UAPF.
Information on investment management of UAPF pension assets and financial instruments in which UAPF pension assets are placed are posted on the official website of UAPF (www.enpf.kz) in the “Indicators/Investment Activity” section on a monthly basis.
The amount of pension savings of contributors (beneficiaries) is recalculated and reevaluated on a weekly basis in accordance with the results of investing pension assets. We emphasize that the investment income arising from investment is a variable value and depends on many factors, including the market value of securities and changes in exchange rates.
It should be noted that pension assets are characterized by a long investment horizon, and in the long term, a positive real return on pension savings is ensured for the entire period from the moment the accumulative pension system was introduced.
It should be noted that regardless of the results of investment activities in Kazakhstan, there is a state guarantee of the safety of compulsory types of pension contributions, taking into account the level of inflation. Even with a decrease in profitability in a particular period, which affected the accumulated profitability of the contributor when the right to pension benefits came into effect, the compensation for the difference is guaranteed by the state and is paid to the contributor automatically when he reaches retirement age, along with the first pension benefit.
Thus, in the accumulative pension system it is expedient to consider indicators of profitability and inflation over a long time horizon.
As of July 1, 2023, pension savings in the amount of KZT16.1 trillion were formed on individual accounts of contributors (beneficiaries) of the Unified Accumulative Pension Fund. Since the beginning of the year, their growth as of July 1, 2023 amounted to KZT1.4 trillion (9.6%). Compared to the same date last year, the volume of pension savings increased by KZT2.7 trillion (or 20.1%).
The increase is formed taking into account incoming flows in the form of contributions and investment income, as well as outgoing - in the form of pension benefits, including according to the schedule and lump sums - for housing and medical treatment, for the purposes of inheritance, burial, departure for permanent residence, etc.
The amount of pension contributions for 6 months of 2023 amounted to KZT1,024.7 billion, which is 26% or KZT213.4 billion more than last year. It should be noted that growth compared to the same period last year occurred in CPC - 26%, COPC - 26%.
96.8% of the savings of Kazakhstanis formed at the expense of compulsory pension contributions (CPC). As of 07/01/2023, the volume of CPC amounted to KZT15.6 trillion (an increase over the year - 19.9%, since the beginning of the year - 9.5%). The amount of pension savings on compulsory occupational pension contributions (COPC) amounted to KZT504.3 billion, having increased by 27.9% since July 1 last year, and by 13.2% since the beginning of this year. The largest increase (60.8% per year) was demonstrated by the accumulation of voluntary pension contributions (VPC), which amounted to KZT4.4 billion.
Net investment income accrued to individual pension saving accounts of UAPF contributors since the beginning of the year amounted to about KZT571.2 billion.
The share of accumulated net income in the structure of pension savings, taking into account payments made, as of July 1, 2023, was 36%.
The number of individual pension saving accounts in the UAPF as of July 1, 2023 amounted to 12.2 million units, including for CPC - 11 million, COPC - 618.6 thousand, VPC - 378.5 thousand.
Since the beginning of the year, UAPF has paid about KZT209.9 billion. As of July 01, 2023, payments by age increased by 25% compared to the same period last year and amounted to KZT71.9 billion (share in total payments - 34.2%), lump-sum pension benefits for the improvement of housing conditions and medical treatment - KZT79.5 billion (share in total payments - 38%) - this is 11 times less than in the same period last year. Also, since the beginning of the year, inheritance payments have been made - KZT25.4 billion, payments in connection with leaving for permanent residence outside the Republic of Kazakhstan – KZT18.6 billion, disability benefits - KZT1,357.5 million, payments for burial - KZT2.6 billion. About KZT10.5 billion transferred to insurance companies.
The size of the average monthly benefit payment according to the schedule from the UAPF (in connection with reaching the retirement age) amounted to KZT32,111, and the maximum amount of the monthly payment was KZT742,692. Recall that for the same period last year, the average monthly payment according to the schedule from the UAPF (in connection with reaching retirement age) amounted to KZT29,794, the maximum - KZT707,326.
All relevant information on statistical data on pension assets, including in the context of the regions of the republic, is posted on the enpf.kz website in the "Indicators" section.
More than 11.5 million statements on the status of individual pension saving accounts (IPSA) were issued by the Unified Accumulative Pension Fund to contributors (beneficiaries) for six months (from January 01, 2023 to July 01, 2023). Of these, 8.7 million (75.8%) were issued in electronic format, 2.5 million (21.4%) in automatic mode, and 281.2 thousand (2.4%) at the Fund's offices. Thus, the issuance of the IPSA statements remains the most popular service of the UAPF.
For six months, the Fund has provided contributors (beneficiaries) with 12.5 million services, of which 8.8 million in electronic format and 2.7 million in automatic format. Accordingly, 92% of services are provided remotely.
However, some contributors (beneficiaries) still prefer the personal service of UAPF. For 6 months, 663.8 thousand services were provided in full-time format (5.3% of the total volume of services), of which 570.9 thousand services were provided in the Fund's divisions. Compared to the same period last year, face-to-face services were provided by 20.9% less, which confirms the growing popularity of online services. Let us remind you that the address of the branch of the Fund closest to you can be found on the website www.enpf.kz or in the БЖЗҚ/ENPF mobile application.
The UAPF field service departments are also actively working, providing more than 88.6 thousand services, of which about 6.6 thousand services were provided to people from socially vulnerable groups of the population.
The most important task for the UAPF is outreach to people, the purpose of which is to increase the level of literacy, knowledge about how to form a pension, and involve them in the process of accumulating and multiplying it. As part of outreach activities, 17.5 thousand road presentations were held, which is 20.6% more than in the same period last year. During the presentations, 379 thousand people received information about the funded pension system and individual consultations. For 6 months since the beginning of the year, more than 22.1 thousand materials have been placed in the media at the initiative of the UAPF, which is 29.7% more than in the same period last year.
UAPF pays special attention to the quality of consulting services. Every year on May 31, the country celebrates the Day of Remembrance of Victims of Political Repression and Famine. Since 2003, 16.1 billion tenge has been paid to victims of political repression in Kazakhstan as one-time monetary compensation and special state benefits. This year, more than 1.3 billion tenge is provided for these purposes.
As a result of the policy of identifying "enemies of the people" in the period from 1921 to 1954, 100 thousand people were convicted in Kazakhstan, 25 thousand of them were subjected to capital punishment – execution.
Millions of Kazakhstanis became victims of famine in 1932-33.
On the territory of the republic there were the largest camps of the GULAG structure – ALGERIA, Steplag, Karlag. Over the years of repression, more than 5 million people were exiled to camps in Kazakhstan. According to some reports, the total number of prisoners significantly exceeds this figure.
In the 1930s and 1940s, Kazakhstan was a place of deportation for millions of Soviet citizens. In the autumn of 1937, hundreds of thousands of Koreans, Turks, Iranians, Kurds and Azerbaijanis were resettled in the republic. Also during the Great Patriotic War, Germans, Greeks, Chechens, Ingush, Karachai, Balkars, Crimean Tatars and other peoples were deported to the country. Their number is estimated at 1 million 200 thousand people.
According to the current legislation, one-time monetary compensation has been paid to victims of political repression and persons recognized as victims of political repression since 2003.
"For the period from 2003 to 2021, a one-time monetary compensation from the republican budget was paid in the amount of 2.9 billion tenge. The amount of compensation ranges from 2,385 tenge (3/4 MCI) to 318,000 tenge (100 MCI). For 2022, 2.1 million tenge is provided in the republican budget for these purposes," Askar Niyazov, Director of the Department of Social Assistance of the Ministry of Health of the Republic of Kazakhstan, said.
In addition, victims of political repression, as well as persons affected by political repression who have a disability or are pensioners, regardless of other types of social benefits, are paid a special state allowance (hereinafter referred to as the SRP) in the amount of 1.07 monthly calculation index (in 2022 – 3,403 tenge).
"For the period from 2005 to 2021, the amount of 13.2 billion tenge was paid from the republican budget of the SGP. 1.3 billion tenge is planned for the payment of the SGP in 2022. As of May 1, 2022, the number of recipients of the SRS from among the victims of mass political repression and victims of political repression amounted to 29,648 people," Askar Niyazov added.
Rehabilitated citizens, as well as persons recognized as victims of political repression, who have disabilities or are pensioners, have the right to:
- offset of the time spent in custody, serving sentences in places of deprivation of liberty, exile, forced labor with restriction of freedom in special settlements and forced treatment in psychiatric institutions in the length of service to receive a pension – in a triple amount;
- getting another working leave at a time convenient for them, as well as for additional leave without pay for up to two weeks a year;
- priority installation of phones;
- priority placement in boarding schools for the elderly and persons with disabilities, accommodation in them on full state support in accordance with the legislation of the Republic of Kazakhstan;
- preferential provision of prosthetic and orthopedic products;
- free consultation of lawyers on issues related to rehabilitation.
In addition, local executive bodies, by decision of local representative bodies, have the right to establish additional measures at the expense of local budgets to provide material and other types of assistance to persons subjected to political repression and rehabilitated in accordance with the legislation of the Republic of Kazakhstan.
Thus, every year on the Day of Remembrance of Victims of Political Repression and Famine, local executive bodies provide one-time financial assistance to victims and victims of political repression.
In 2022, at the expense of local budgets, one-time financial assistance will be provided to 8,232 citizens in the amount of 182 million tenge in the amount of 3,278 tenge to 47,700 tenge.
Unified Accumulative Pension Fund Joint Stock Company continues to work actively to recover bad debts resulting from default on pension assets.
Recall that UAPF has been carrying out this work since the transfer of pension assets from private accumulative pension funds to UAPF. At the time of completion of the transfer of pension assets to UAPF in 2014, there were 32 problem issuers in the Fund’s portfolio and their debt amounted to KZT 161.45 bln at par.
As of August 2020, UAPF is working on debt recovery in relation to the remaining 19 issuers that defaulted. These 19 problem issuers can be roughly divided into the following groups:
(Rosa JSC, Kazakhstan Kagazy JSC and Imstalkon JSC). There are 3 issuers in total.
The amount owed by these issuers at par is KZT15.80 bln
Thus, as of August 2020, the total amount of debt (at the expense of pension assets) for the above 19 problem issuers is KZT46.33 bln, at par, and taking into account the debt of Holding “Kazexportastyk” JSC on payment of coupon interest in the amount of KZT5.8 bln, the total amount of debt will be KZT52.13 bln.
Note that as of July 31, 2020, the total amount of debt on pension assets repaid to UAPF amounted to KZT23.634 bln including:
in 2014-2016 – KZT 1.475 bln,
in 2017 - KZT 1.249 bln,
in 2018 – KZT 14.853 bln,
in 2019 - KZT4.507 bln,
In total for seven months of 2020 – KZT 1.55 bln, which came from:
In addition, according to the results of the claim work carried out in the current year to collect the debt of Atameken-Agro JSC, as of July 1, the debt of this issuer was repaid in full in the amount of KZT1,015,160,000.
At the same time, UAPF is taking measures to initiate criminal proceedings in order to bring to justice those responsible for causing damage to pension assets.
So, today, with the participation of the Fund, criminal proceedings are underway against 12 issuers - GLOTUR JSC, Imstalkon JSC, REMIX-R JSC, Rosa JSC, Mineral Resources of Central Asia JSC, HOMEBROKER JSC, Kazneftekhim JSC, Kazakhstan Kagazy JSC, Kazinvestbank JSC, Delta bank JSC, LANDSBANKI, Astana-Nedvizhimost JSC.
It is worth noting that the pre-trial investigation against the former managers and shareholders of two issuers (Imstalkon JSC and REMIX-R JSC) has been completed to date. The case materials were submitted to the court for consideration. Based on the results of the court hearings, the court will give an appropriate assessment of the actions of these persons. Also, in order to compensate for damage caused by the criminal offense, the Fund filed claims for compensation for this damage caused to the pension assets of the UAPF. This damage will also be reimbursed if convicted.
It is important to emphasize that a number of heads of these organizations are evading the investigative bodies, and therefore the former head and shareholder of Imstalkon JSC Vladimir Kananykhin, the former chairman of the board of REMIX-R JSC Timur Bespayev, as well as the head and shareholder of Kazneftekhim JSC Edyl Kirishev are in the wanted list. Their search has been going on for more than two years.
