On December 10 of this year, the Law of the Republic of Kazakhstan No. 273-VI of November 26, 2019 "on amendments and additions to certain legislative acts of the Republic of Kazakhstan on public service and anti-corruption" came into force, which provides for the possibility of non-competitive appointment to the civil service of graduates of leading foreign Universities, as well as persons with experience in international, transnational and foreign companies, managers in quasi-public sector entities
There is an opportunity to improve the skills of civil servants in other educational organizations in the field of activity of the state body. Previously, professional development and retraining of civil servants was carried out only at the Academy of public service. Now, in highly specialized areas, state agencies can train their employees in industry-specific educational organizations. For example, this may be the areas of Geology, subsurface use, agriculture, Finance, and others.
It is planned to replace the service certificates of administrative civil servants with identification cards. They will be prominently displayed as badges. This will increase the client orientation of civil servants.
When visiting a government Agency, citizens will see the position and surname of the civil servant, which will greatly simplify communication.
It establishes the obligation of civil servants who are studying under the state order to reimburse the budget funds allocated for their training, in case of non-completion of training. Currently, it is already planned to work out at the end of training. However, reimbursement of funds by persons who have not completed training is carried out on the basis of separate agreements. Now this is regulated at the legislative level.
It provides for the cancellation of the probation period for persons re-entering the civil service, with the exception of persons who were previously dismissed based on the results of evaluation of their activities, probation, certification results, or for negative reasons.
The probationary period is established to determine the candidate's ability to perform official duties.
In order to strengthen the ethics of civil servants, restrictions are imposed on holding positions in the order of transfer, as well as on the results of an internal competition if a civil servant has not received a disciplinary sanction for violating the norms of official ethics. Currently, a similar restriction applies to persons who have committed an offense that discredits the civil service. At the same time, the possibility of imposing a disciplinary penalty in the form of demotion to a temporarily vacant position is excluded.
A civil servant may not hold a public office that is directly subordinate to the position held by his close relatives (parents (parent), children, adoptive parents (adoptive parents), adopted (adopted), full and half-siblings, grandparents, grandchildren) or spouse, as well as relatives (brothers, sisters, parents and children of the spouse), except in cases provided for by the legislation of the Republic of Kazakhstan.
Person within thirty calendar days from the date of dismissal from public service, except for dismissed on negative motives or the results of their performance assessment, probationary period or the outcome of the appraisal, shall be entitled to participate in the contest and elections for vacant administrative state position of corps "B" without testing if it was not in an employment relationship with other individuals and legal entities, non-governmental bodies, as well as not traveled outside of the Republic of Kazakhstan.
In these cases, this person is not subject to the requirements for passing a mandatory special inspection and submitting a Declaration of income and property belonging to him on the right of ownership, provided that it is handed over by him at his previous place of work.
At the same time, only the person who was dismissed from this state body has the right to participate in the internal competition among civil servants of this state body.
Civil servants participating in the competition are not tested.
Civil servants and persons specified in the first part of paragraph 8 of article 27 participating in the competition are evaluated for personal qualities in cases determined by the authorized body.
The amendments to the current legislation on civil service contribute to further improvement of the activities of civil servants.
