on the Republican action
“Enter into an employment contract!”
General Provisions
This algorithm of actions for the conduct of the republican action "Enter into an employment contract!" establishes the procedure for holding in 2018-2019 by the central and local executive bodies, social partners of the republican campaign “Enter into an employment contract!”
Informal labor relations should be understood as the use by individuals and legal entities of the labor of hired workers without concluding an employment contract if there are signs of an employment relationship (employees performing work (labor function) for a specific qualification, specialty, profession or position, fulfilling obligations personally with subordination to the work schedule), with the employee receiving wages in envelopes.
Goals and objectives
The purpose of the nationwide campaign "Enter into an employment contract!" is the prevention and identification of informal labor relations, the reduction of hidden forms of labor relations, increasing the level of awareness of citizens about their rights in the field of labor.
The objectives of the republican action "Enter into an employment contract!" are:
formalization of labor relations;
involvement of informally employed citizens in the pension, social and health insurance system;
formation of a negative attitude towards informal employment among the population;
strengthening administrative response and control measures through preventive monitoring based on the assessment of the risks of informal employment, through visits to employers and self-employed;
conducting mass explanatory work among the population with the participation of government bodies, social partners using media resources.
Organizers
The organizers of the republican action "Enter into an employment contract!" are:
At the republican level:
Ministry of Labor and Social Protection of the Population of the Republic of Kazakhstan (hereinafter - MTSZN RK);
National Chamber of Entrepreneurs of the Republic of Kazakhstan “Atameken” (hereinafter - NPP RK);
Federation of Trade Unions of the Republic of Kazakhstan (hereinafter - FP RK);
At the regional level:
Akimats of regions, Astana and Almaty;
regional chambers of entrepreneurs;
territorial associations of trade unions;
Akimats of regions, g. Astana and Almaty are creating an organizing committee for the rally with the participation of regional branches of NPP RK, territorial associations of trade unions of the Republic of Kazakhstan.
Target groups
Target groups of the action are:
economic entities of small and medium-sized businesses in the agricultural, construction industry, trade, public catering, transport, services for servants, etc .;
citizens working in these areas.
Dates
Republican action "Enter into an employment contract!" held in 2018-2019.
The official start of the campaign “Enter into an employment contract!” announced at a press conference of the Ministry of Labor with the participation of social partners in the 1st quarter of 2018.
The interim results of the action “Enter into an employment contract!” considered quarterly at meetings of the republican and regional tripartite commissions on social partnership and the regulation of social and labor relations.
Summing up the Republican campaign “Enter into an employment contract!” It is carried out annually in December at meetings of the RTK.
The interaction of central and local executive bodies, social partners on the legalization of informal labor relations
At the republican level:
MTSZN RK:
monthly monitors the progress of the "Conclude an employment contract!"
during 2018, organizes information support for the action “Enter into an employment contract!” in the media;
spends in areas and years. Astana and Almaty forums with employers;
monthly sends information to the SRC MF, IOI (GIT) and NPP about enterprises that have allowed a decrease in the amounts transferred to the UAPF and GFSS by regions, enterprises;
carries out monthly monitoring of measures taken by MIO and QGD to employers who have allowed a reduction in the amount of social contributions and mandatory pension contributions by 50% (90%) and more percent.
Republican Association of Trade Unions (ROP RK):
conduct work on studying ways to attract workers in the informal economy in the trade union movement;
conduct surveys among labor collectives by means of questionnaires in order to identify the causes of informal employment in order to further develop proposals to stimulate workers to legalize their activities;
take measures to strengthen public control over compliance with labor laws by employers who have created primary trade union organizations;
cooperate with state bodies for monitoring the implementation of legislation
