What do citizens of the Republic of Kazakhstan need to know when working in the EEU countries?
On December 20, 2019, the heads of the countries of the Eurasian economic Union (EEU) signed an Agreement on pension provision for workers of the member States of the Eurasian economic Union, which will regulate the issues of pension provision for workers of the EEU countries and their families.
Despite the fact that this Agreement has been signed, it will enter into force only after its ratification by the parliaments of all the EEU countries.
However, citizens of the EEU countries, including citizens of the Republic of Kazakhstan who work in the EEU countries, need to know the following:
1) the EEU countries are: Armenia, Belarus, Kazakhstan, Kyrgyzstan and Russia;
2) the Agreement defines that the employee is a citizen of a member state of the EEU, who has formed or was formed pension rights through employment or other activities on the territory of another member state;
3) the formation of pension rights of workers is carried out at the expense of pension contributions on the same terms and in the same manner as the formation of pension rights of citizens of the state of employment.
At the same time, pension contributions include:
in Armenia-taxes and (or) other contributions that give the right to a pension;
in Belarus - insurance premiums for mandatory pension insurance;
in Kazakhstan-pension contributions to the unified accumulative pension Fund;
in Kyrgyzstan-insurance contributions to the pension Fund
Fund and State funded pension Fund;
in Russia - insurance premiums for mandatory pension insurance.
In each of the EEU countries, pension contributions are paid for employees who are officially employed, that is, they work under an employment or civil law contract, respectively, if a citizen works in the shadow sector, then pension contributions will not be paid for them and this Agreement will not apply to them.
In this regard, workers, including citizens of the Republic of Kazakhstan, who are engaged or plan to work in the EEU countries in the future, in order to form pension rights and their subsequent implementation within the framework of the Agreement (receiving a pension for work experience acquired in the EEU countries after the entry into force of the Agreement), it is mandatory to conclude labor or civil contracts with employers.
