The Commission for the Affairs of Minors and the Protection of Their Rights is a permanent collegial body that coordinates the activities of state bodies and institutions in the field of prevention of delinquency, neglect and homelessness among minors.
An interdepartmental commission on minors' affairs and protection of their rights is formed under the Government of the Republic of Kazakhstan, and regional, city, district - in the city, district - under the appropriate local executive body (akimat).
If necessary, a commission on minors' affairs and protection of their rights may be formed under the akim of a settlement, village, rural district located at a considerable distance from the regional center. The commission on minors' affairs and protection of their rights under the akim of the settlement, village, rural district has the rights and obligations of the district commission. The decision on the formation of a settlement, rural, rural district of commissions for minors and the protection of their rights is taken by the regional akimat, and the staff is approved by the maslikhat of the corresponding district.
The Commission for the Affairs of Minors and the Protection of Their Rights is formed in the composition of the chairman, deputy chairman, members of the commission and the secretary. The chairman of the commission is the deputy akim of the corresponding administrative-territorial unit, with the exception of the settlement, rural commission and the commission of the rural district, which are headed by the akim of the corresponding administrative-territorial unit. The secretary holds a full-time position in the staff of the relevant state body.
The composition of the commission on affairs of minors and the protection of their rights includes deputies of the relevant maslikhats, representatives of internal affairs, education, culture, health care, justice bodies, an authorized body for employment, guardianship and guardianship, public and other organizations interested in the prevention of offenses, neglect and homelessness among minors.
Commissions for minors and the protection of their rights within the limits of their competence:
1) take measures to protect and restore the rights and legal interests of minors, identify and eliminate the causes and conditions conducive to the commission of delinquency among minors, prevent child neglect and homelessness, protect minors from violence and cruel treatment, antisocial actions among minors;
2) develop programs and methods aimed at improving the activities of state bodies for the prevention of delinquency, neglect and homelessness among minors, violence and cruel treatment of minors, their social rehabilitation;
3) participate in ensuring control over the conditions of upbringing, education, and maintenance of minors in organizations performing functions to protect the rights of the child;
4) study the state of delinquency among minors, child neglect and homelessness, as well as violence and cruel treatment of minors and organize sociological research on these issues;
5) assist in the development of a network of organizations performing functions for the protection of the rights of the child, and ensure monitoring of their activities;
6) generalize and disseminate the positive experience of bodies and organizations involved in the prevention of delinquency, neglect and homelessness among minors, violence and cruel treatment of minors, provide them with methodological and practical assistance;
7) hear reports from the heads of interested state bodies on the work carried out on the prevention of delinquency, neglect and homelessness among minors, violence and cruel treatment against minors, protection and restoration of their rights and legitimate interests, and organize the exchange of information between them on supervised issues;
8) participate in the preparation of materials to the court on the issues of sending minors to special educational organizations and educational organizations with a special regime of detention;
9) coordinate the activities of interested bodies in the labor and household arrangement of minors released from institutions of the penal system or returned from special educational organizations and educational organizations with a special regime of detention, as well as in the implementation of other functions for the social rehabilitation of minors in difficult life situations ;
10) organize in the media coverage of the ongoing work on the prevention of offenses, neglect and homelessness among minors, violence and cruel treatment of minors;
11) monitor the activities of lower commissions for minors and the protection of their rights;
12) coordinate the activities of lower commissions for minors and the protection of their rights.
The procedure for the formation and organization of the activities of the commissions for minors and the protection of their rights are determined by the legislation of the Republic of Kazakhstan.
Since January 2022, the Commission on Juvenile Affairs and Protection of Their Rights under the Akimat of the Uygur district has considered 30 materials at 10 meetings. In relation to underage adolescents, a decision was made on the need to send a statement of claim to the court with a requirement to restrict parental rights for 2 materials, 1 material on the determination of a special boarding school, 2 materials on the appointment of guardianship and 25 materials on preventive work.
