1) the amount of pension savings that exceeds the threshold of the minimum sufficiency of pension savings.
While lump-sum pension payment may not exceed the amount of the difference between the amount of pension savings at the expense of OPV and (or) oppw of the depositor (recipient) and the minimum threshold of adequacy of retirement savings, calculated according to the Method of determining the minimum threshold for the adequacy of retirement savings, approved by the Government of the Republic of Kazakhstan on the date the email is sent from an authorised dealer;

When calculating the replacement rate of the average monthly income, the recipient's income before the retirement date is taken into account, but not more than the average monthly income for the republic.
At the same time, a one-time pension payment may not exceed 50 percent of the amount of pension savings due to the OPV and (or) OPV of the depositor (recipient) on the date of receipt of the initial electronic notification from the authorized operator;
3) who have entered into a pension annuity agreement with an insurance company.
At the same time, a one-time pension payment may not exceed the amount of pension savings at the expense of OPV and (or) OPV in the individual pension accounts of the depositor (recipient).

3) Good afternoon! I am preparing to receive my pension savings ahead of schedule and I am interested in paying individual income tax. Will I pay for it in full now? How will I be paid for my remaining savings after retirement? Are there any deductions?
In order to determine the procedure for levying taxes on lump sum pension payments from the SAPF article 351-1 Tax Code of the Republic of Kazakhstan "On taxes and other obligatory payments to the budget" provides the features of the calculation, withholding and payment of the pit (personal income tax) with lump-sum pension payments to improve housing conditions and (or) payment of the treatment, carried out in accordance with the pension legislation of the Republic of Kazakhstan.
While PPI is calculated by applying the rates set out in article 320 of the Tax code (10%), the amount of lump-sum pension payments.
Withholding and remitting pit on the amounts of lump-sum pension payments according to paragraph 2 of article 351-1 Tax code of the SAPF are manufactured in accordance with the application of an individual retention pit one of the following ways:
1) at a time, no later than the day of the implementation of a one-time pension payment in accordance with the procedure provided for in Article 351 of the Code;
2) monthly in equal shares for no more than sixteen years according to the schedule established by the UAPF for pension payments.
Pit withholding is based on the application of retention pit presented by individual tax agent in the face of SAPF in the form established by the authorized body in coordination with the authorized body in the sphere of pension provision.
Thus, when filing an individual statements about the retention pit with lump-sum pension payments under subparagraph 2) of paragraph 2 of article 351-1 Tax code withholding and remitting pit will be the SAPF upon reaching the retirement age established SPSF graphics for pension payments.
Please note that Article 351-1 of the Tax Code, which defines the specifics of calculating, withholding and paying individual income tax on a one-time pension payment, does not provide for the provision of tax deductions. That is, tax deductions from the tax base for calculating the PII will not be applied only in the part of one-time pension payments.
Upon subsequent retirement, the recipient retains the right to apply tax deductions for pension payments from the UAPF in accordance with the procedure established by paragraph 3 of Article 353 of the Tax Code.
Recall that mandatory pension contributions (OPV) are not subject to individual income tax( IIT), IIT is withheld when receiving pension payments. In this case, tax deductions are applied (the amounts that are deducted from the tax base to calculate the amount of tax withheld).
Let's look at the numbers. For example, the payment from the UAPF is 50 000 tenge, for the calculation of the PPI as a tax deduction, one minimum wage (MZP) is applied - 42 500 tenge. In this case, the amount subject to the IIT (or tax base) will be 7,500 tenge (50,000 tenge - 42,500 tenge = 7,500 tenge). It is from this amount that the PII in the amount of 10% or 750 tenge will be deducted.
Thus, the recipient will be transferred an amount of 49,250 tenge (50,000 tenge-750 tenge = 49,250 tenge).
If the recipient previously used the right to a lump-sum pension payment, for example, previously seized from his individual retirement account 5 million tenge with the payment of deferred pit (10% or 500 thousand tenge) pension age, the pension of the recipient in the pension age will change as follows.
The amount of the deferred PPI will be divided by the number of pension payments, but not more than 192 payments (the payment of the deferred PPI is carried out for a period not exceeding 16 years). 500,000 tenge / 192 payments = 2,604. 16 tenge.
And the recipient will be transferred an amount of 46,645. 84 tenge (50,000 tenge-750 tenge-2,604. 16 tenge = 46,645. 84 tenge).
