Changes to the rules of public procurement from January 1, 2020 were made by order of the first Deputy Prime Minister of Kazakhstan – Minister of Finance RK from 27.12.2019 № 1438.
The main changes in the Rules for public procurement that will come into force on 01.01.2020:
E-wallet
The bid security will also be provided in purchases by requesting price offers.
The application security in the form of a guarantee payment was replaced with sufficient funds on the potential supplier's e-wallet (at least 1% of the allocated purchase amount).
Electronic Depository
When purchasing works in the construction sector, documents confirming work experience – acts of completed works and acts of commissioning - will be drawn exclusively from the electronic Depository.
New criteria in the competition
A new criterion that affects the competitive price offer is the indicator of taxes paid. If a potential supplier has a tax rate of more than 3 %, the web portal automatically assigns a conditional discount "for each one-tenth (0.1) percent exceeding one-tenth (0.1) percent", but no more than 3 % (clause 156 of the Rules).
From the criteria that affect the competitive price offer – clause 152-1 of the Rules, documents that confirm:
- voluntary confirmation of compliance of the offered products in accordance with the legislation Kazakhstan in the field of technical regulation;
- compliance of the certified quality management system corresponding to the subject of purchased goods, works, services in accordance with the requirements of national or international standards;
– compliance of the environmental management system with the national standard;
- compliance of the offered products with the standard of environmentally friendly products.
Determining the winner if the conditional prices are equal
If the conditional prices of competitive price offers are equal, the winner will be recognized as the participant who has a higher tax burden, and not a larger amount of taxes paid, as it was before. Now, if the conditional prices are equal, small companies will be able to compete with large companies in terms of tax burden. It will also be an incentive to pay taxes in good faith.
