Analytical report on the results of an internal analysis of corruption risks in the activities of the akim's office of the Avat rural district

Introductory part
In accordance with paragraph 5 of Article 8 of the Law of the Republic of Kazakhstan dated November 18, 2015 "On Combating Corruption", in order to prevent corruption, an Internal analysis of corruption risks was carried out in the State Institution of the Akim of the Avat Rural District in order to prevent corruption on the basis of the Order of the Akim of the Avat rural District No. 22 dated April 7, 2022 "On conducting an internal analysis of corruption risks" in the activities of the akim's office of the Avat rural district. The internal analysis covered the first quarter of 2022. The office of the akim of the rural district carries out its activities on the basis of the Regulations on the state institution "The Office of the akim of the Avat rural district", approved by the Resolution of the Akimat of the Enbekshikazakh district dated August 15, 2016 No. 815. The mission of the State Institution "Akim's Office of the Avat rural District": the implementation of state policy in the territory of the Avat rural district of the Enbekshikazakh district. In accordance with the "Standard Rules for Internal Analysis of Corruption Risks" approved by the Order of the Chairman of the Agency of the Republic of Kazakhstan for Civil Service Affairs and Anti-Corruption No. 12 dated October 19, 2016, an internal analysis of corruption risks was conducted in the following areas:
Identification of corruption risks in regulatory legal acts
1. The state institution "Apparat of Akim of the Avat rural District" in its activities is guided by the Constitution and Laws of the Republic of Kazakhstan, acts of the President and Government of the Republic of Kazakhstan, and other regulatory acts, as well as the Regulations on the state institution "Apparat of Akim of the Avat rural district".
Identification of corruption risks in the organizational and managerial activities of the akim's office of the Avat rural district
In the state institution of the "Akim's Office of the Avat rural district" personnel work, including the turnover of personnel.
2.1. According to the approved staffing of the state institution "Akim's Office of the Avat rural District" dated December 30, 2021, the staff number is 8 people. To date, there are no vacancies. During the analysis it was found: from January 5, 2022 to March 31, 2022 in the Avatsky rural district, dismissed at their own request: no. There are no dismissed for negative reasons.

In the line of public services
The office of the Akim of the Avat rural District in its activities for the provision of public services is guided by the Law of the Republic of Kazakhstan "On the provision of public services" and other regulatory acts of the Republic of Kazakhstan in the field of public services.
The office of the akim of the Avat rural district provides 5 types of public services.
"Issuance of a decision to change the purpose of a land plot"
"Provision of a land plot for the construction of an object within the settlement"
"Acquisition of rights to land plots that are in state ownership, which does not require bidding (contests, auctions)"
"Queuing for a land plot"
"Sale to private ownership of a land plot previously granted for land use"
From January 5, 2022 to March 31, 2022, 49 public services were provided in the Avat rural district.
The media plan of the akim's office of the Avat rural district for informing service recipients about the procedure for the provision of public services for 2022 was approved on December 20, 2021 by the akim of the Avat rural district (articles by specialists of the akim's office of the rural district on the provision of public services through the State Corporation and the web portal "electronic government" in the media).
From the beginning of 2022 to March 31, 2022, applications and complaints on the provision of public services from individuals and legal entities were not received. A memo on corruption prevention is printed on the reverse side of the response form to the applications received by the akim of the Shelek rural District from individuals and legal entities.
In order to comply with the requirements of the order of public services provided by the office of the akim of the Avat rural district, articles are constantly published in the newspaper "Enbekshikazakh" and information is posted on the website of the akimat of the district. The office of the akim of the Avatsky rural district adopted regulations on the approval of the responsible deputy akim of the rural district to conduct internal control and improve the quality of public services, as well as a responsible specialist for the timely submission of reports on the provision of public services. In the building of the akim's office of the Avat rural district, there is a stand for informing the population about the procedure for providing public services, phone numbers for inquiries and samples of application forms. Monthly specialists of the office of the akim of the rural district conduct to clarify the receipt of electronic public services. In order to reduce corruption risks, the office of the akim of the Avat rural District is working on the full transfer of public services through the State Corporation and through the e-government web portal. To do this, there is a "Self-service Corner with access to the e-government portal" on the 1st floor in the building of the akim's office of the Avat rural district, the "Self-service Corner" is fully equipped with computer equipment, a printer, a card reader, a webcam. There is also a self-service corner and a children's corner. For the convenience of visitors, waiting chairs and a TV monitor are installed.
During the reporting period, there were no complaints about the provision of public services from citizens.
Proposal: In order to prevent violations of public service standards, to hold a seminar-meeting and a round table together with employees of the state corporation, to increase the responsibility of civil servants.
Risk of direct contact
In the office of the akim of the Avat rural district, there is a risk of direct contact with the service recipient, since some public services were provided in paper form – this is "Queuing for a land plot". From March 4, 2022 on the egov e-government portal.kz has launched a service of queuing for obtaining a land plot for individual housing construction (10 acres), as well as a data updating service, in connection with which applications for obtaining a land plot are accepted in electronic format, therefore seminars, studies and other events are held for specialists of the akim of the Avatsky rural district who provide public services. Currently, applications for the provision of public services of the TSA are accepted through the portal of "electronic government" (PEP) "Egov", therefore, all necessary measures have been taken to provide the "Self-service Corner" with the necessary equipment.
The office of the akim of the Avat rural District is working to inform service recipients about the possibility of providing public services in electronic form (articles, information, announcements in the media).
Other issues related to the organizational and managerial activities of the akim of the Avat rural district.
5.1. In the state institution "Akim's Office of the Avat rural District", appropriate measures are being taken to ensure compliance with the requirements, deadlines for consideration established by the Administrative Procedural Code of the Republic of Kazakhstan and the information system "E-onish". During the analysis, it was found that there are no violations in the office of the akim of the rural district regarding the consideration of appeals of individuals and legal entities, objective, comprehensive and timely consideration of appeals of individuals and legal entities is provided.
Proposal: Strict compliance with the requirements established by the Administrative Procedural Code of the Republic of Kazakhstan and the information system "E-onish".

Based on the above, we recommend that the akim of the Avatsky rural district:
Conduct work in accordance with the Regulations of the state institution "Apparatus of the akim of the Avat rural district".
Strictly observe and take control of the standards and regulations of public services provided in the state institution "Akim's Office of the Avat rural District", as well as carry out activities according to the plan.
To carry out work on informing the provision of public services in the state institution "Akim's Office of the Avat rural district", and take control.
