"On the fight against corruption"

To date, in Kazakhstan, the fight against corruption has been given a nationwide status, a large-scale anti-corruption campaign is being conducted together with public and political forces to curb and limit manifestations of corruption. The fight against corruption in Kazakhstan has been identified as one of the main priorities of state policy. Whatever aspects of the fight against offenses are discussed at various levels, corruption is necessarily one of the characteristic signs of its scope.

That is why the President in his Strategy "Kazakhstan-2050" called the New political course of the established state as one of the priorities of the state the fight against corruption.

A large circle of political scientists, economists, lawyers widely in articles and publications reveal both the very concept of "corruption" and the fight against it. The country has modern anti-corruption legislation, which is based on the laws "On Combating Corruption" and "On the Civil Service of the Republic of Kazakhstan", a special authorized body has been formed that comprehensively implements functions in the field of public service and anti-corruption, international cooperation in the field of anti-corruption activities is actively carried out.

Comprehensive measures have been taken to develop the sphere of public services and informatization of the work of the state apparatus, reducing direct contacts of officials with citizens and minimizing conditions for corruption phenomena.

Most often, the share of corruption crimes is associated with abuse of official authority (Article 361 of the Criminal Code) - 15, embezzlement or embezzlement of someone else's entrusted property (Article 189 of the Criminal Code) - 7, receiving a bribe (Article 366 of the Criminal Code) - 5.

It should be noted that in accordance with the Law "On Combating Corruption", the measure of disciplinary punishment for committing a corruption offense has been excluded, now criminal and administrative liability is provided for the commission of a corruption offense.

Due to the fact that the Law excluded corruption offenses entailing disciplinary penalties, the record keeping of persons brought to disciplinary responsibility for committing a corruption offense (including offenses that create conditions for corruption) was discontinued.

Offenses for which persons were previously brought to disciplinary corruption responsibility have passed into the category of disciplinary offenses discrediting the civil service (Article 50 of the Law "On Civil Service of the Republic of Kazakhstan"), with similar restrictions for entering the civil service.

The basis for the registration of persons is the fact that they have committed a disciplinary offense discrediting the civil service, specified in Article 50 of the Law "On the Civil Service of the Republic of Kazakhstan", as well as the presence of an act of the head of the state body on bringing a person to responsibility or decisions of the relevant commissions authorized to consider the disciplinary responsibility of civil servants.

For the purposes of informational and statistical support Laws of the Republic of Kazakhstan "On State legal statistics and special records", "On Law Enforcement service" and "On the Civil Service of the Republic of Kazakhstan", the Committee of the State Duma of the Republic of Kazakhstan and its territorial administrations have been keeping records of persons dismissed from public service for negative reasons since 2011.

I would like to note that the efforts of law enforcement agencies alone cannot be effective enough without a comprehensive approach to the fight against corruption, without the active participation of all state bodies, political parties, public associations and the population in this work. This is the only way to really reduce the level of corruption.
