State environmental expertise is carried out by the authorized body in the field of environmental protection and local Executive bodies within their competence in accordance with the requirements of the Environmental code (article 48). The procedure for conducting state environmental expertise is determined by the authorized body in the field of environmental protection (article 49), which creates expert councils of state environmental expertise, which are Advisory bodies. Members of such expert councils may be members of the public (article 56). At the same time, all interested citizens and public associations are given the opportunity to Express their opinion during the state environmental assessment (article 57). In addition, public hearings are held on projects that may directly affect the environment and the health of citizens. The organization of public hearings during the state environmental assessment is referred to the competence of the relevant local Executive bodies (article 20 of the Environmental code). The rules for holding public hearings were approved by order No. 135-p of the Minister of environmental protection of may 7, 2007. They are based on the principles of ensuring the constitutional rights of citizens and public organizations to timely receive sufficient and complete information about the state of the environment and public participation in the process of making environmentally significant decisions. The hearing provides an opportunity for everyone to speak out in accordance with the established rules, since the hearing provides an equal opportunity for all interested parties to Express their reasoned opinion on the issue under discussion based on the study of documentary information relevant to the issue under discussion and does not contain confidential information. The client submits to the state environmental expertise the Protocol of public hearings and the draft with the results of the EIA, finalized with the public opinion, in case of its qualified justification based on the normative legal acts of the Republic, as well as comments on public proposals for which the Client considers it unreasonable to make changes and additions to the project. After making a decision on the conclusion of the state environmental assessment, all interested persons are given the opportunity to obtain information on the object of the examination (article 57). Disagreements in the implementation of the state environmental assessment are considered through negotiations or in court (article 58). Such disputes should be resolved in accordance with environmental legislation, including the provisions of the Aarhus Convention.
