Regulations on the Special Commission
Chapter 1. General provisions
1. This Regulation on the Special commission (hereinafter referred to as the Regulation) defines the status and powers of the special commission to consider the application of a person (family) applying for social assistance to certain categories of needy citizens.
2. The basic concepts used in this Regulation:
1) a special commission (hereinafter referred to as the Commission) is a commission created by the decision of the akim of a district (city of regional significance) to consider the application of a person (family) applying for social assistance to certain categories of needy citizens;
2) authorized state body - the central executive body that carries out management and intersectoral coordination in the field of social protection of the population in accordance with the legislation of the Republic of Kazakhstan, regulation, control functions over the activities of the State Social Insurance Fund.
3. The Commission is a permanent collegial body on the territory of the district (city of regional significance), the district in the city.
The Commission organizes its work on the principles of openness, transparency, collegiality and impartiality.
4. The Commission in its activities is guided by the Constitution, laws of the Republic of Kazakhstan, acts of the President and Government of the Republic of Kazakhstan, regulatory legal acts of the Republic of Kazakhstan, as well as this Regulation.
5. Control over the activities of the Commission is carried out by the deputy akim of the district (city of regional significance) in charge of social protection issues.
Chapter 2. The task and function of the Commission
6. The main task of the Commission is to determine the need of citizens for social assistance according to the list of grounds for classifying citizens as needy approved by the local representative body in accordance with paragraph 2-3 of Article 6 of the Law of the Republic of Kazakhstan "On Local Public Administration and Self-Government in the Republic of Kazakhstan".
7. The main function of the Commission is to issue an opinion on the need for social assistance (hereinafter referred to as the conclusion), indicating the amount of social assistance in each individual case, in the form according to the annex to this Regulation.
Chapter 3. Organization of the Commission's activities
8. The Commission carries out its activities free of charge.
9. The Commission includes representatives of interested structural units of the local executive body, including organizations and authorized bodies of education, health, social protection, law enforcement officials, public associations.
The Commission consists of a chairman, a secretary and members of the commission.
The total composition of the Commission is not less than seven people.
10. The Chairman is the deputy akim of the district (city of regional significance) in charge of social protection issues.
The Chairman organizes the work of the Commission and ensures timely and high-quality performance of the tasks and functions assigned to the Commission by this Regulation.
11. The working body of the Commission is the local authorized body - the departments of employment and social programs of the district (city of regional significance), the district in the city.
The duties of the Secretary of the Commission are assigned to the specialist of this department.
12. The Commission, within two working days from the date of receipt of the full package of documents from the local authorized body, reviews the submitted documents and decides by open vote on the need to provide social assistance.
13. The decision of the Commission is valid in the presence of two-thirds of the total number of its members.
14. The decision of the Commission is considered adopted if a majority of votes from the total number of members of the commission is submitted for it. In case of equality of votes, the vote of the Chairman of the Commission is considered decisive.
15. The adopted decision of the Commission shall be drawn up in the form of an opinion and, within the period specified in paragraph 12 of this Regulation, transferred to the local authorized body.
If the conclusion is positive, the amount of social assistance is indicated.
16. When determining the amount of social assistance, the Commission is guided by the rules for providing social assistance, setting the size and determining the list of certain categories of needy citizens approved by local representative bodies in accordance with paragraph 2-3 of Article 6 of the Law of the Republic of Kazakhstan "On Local Public Administration and Self-Government in the Republic of Kazakhstan".
