Regulations on precinct commissions
Chapter 1. General provisions
This Regulation on Precinct Commissions (hereinafter referred to as the Regulation) defines the status and powers of precinct commissions.
Basic concepts used in this regulation:
career center is a branch of the labor mobility center that performs its functions in districts and cities of regional significance;
the authorized body for the appointment of state targeted social assistance is the local executive body of a district, a city of regional significance, a district in a city, a city of district significance, carrying out the appointment of targeted social assistance;
the precinct commission (hereinafter referred to as the Commission) is a special commission created by the decision of the akims of the relevant administrative-territorial units to conduct a survey of the financial situation of persons (families) who have applied for targeted social assistance.
The authorized body for the purpose of targeted social assistance provides social assistance in accordance with the Rules for the Provision of Social assistance, establishing its size and determining the list of certain categories of needy citizens approved by the local representative body.
The Commission conducts a survey of the financial situation of persons (families) who have applied for social assistance.
The Commissions are a permanent collegial body on the territory of the respective administrative-territorial units.
The Commissions organize their work on the principles of openness, transparency, collegiality and impartiality.
Commissions in their activities are guided by the Constitution, Laws of the Republic of Kazakhstan, acts of the President and Government of the Republic of Kazakhstan, regulatory legal acts of the Republic of Kazakhstan, this Regulation, as well as criteria for determining the need for state targeted social assistance based on the results of a survey of the applicant's financial situation.
Chapter 2. Tasks and functions of the Commission
The main task of the Commission is to assist the authorized body for the purpose of state targeted social assistance, and in rural areas - the akim of a village, village, rural district in the provision of state targeted social assistance to the population (hereinafter referred to as targeted social assistance) or social assistance provided in accordance with the Rules for Providing social assistance, setting the size and determining the list certain categories of needy citizens (hereinafter - Rules) approved by the local representative body in accordance with paragraph 2-3) of Article 6 of the Law of the Republic of Kazakhstan "On Local Public Administration and Self-Government in the Republic of Kazakhstan", to increase their targeting.
The main functions of the Commission include:
1) conducting a survey of the financial situation of the person (family) who applied for the appointment of targeted social assistance or the provision of social assistance provided in accordance with the Rules (hereinafter referred to as the survey);
2) sending a request to the relevant authorities to obtain the missing information necessary for conducting a survey of the financial situation of the person (family) who applied for the appointment of targeted social assistance;
3) drawing up an act of examination of the financial situation of a person (hereinafter referred to as the applicant) who applied for the appointment of targeted social assistance or the provision of social assistance provided in accordance with the Rules;
4) on the basis of the submitted documents and (or) the results of the survey, preparation of a conclusion on the need to provide or on the absence of the need to provide targeted social assistance or social assistance provided in accordance with the Rules, taking into account the criteria for determining the need for state targeted social assistance based on the results of the survey of the applicant's financial situation approved by the authorized state body.
Chapter 3. Organization of the Commission's activities
The regulation of the Commission is developed on the basis of a Model regulation on precinct commissions in coordination with the Aktobe regional Maslikhat and approved by the resolution of the Akimat of the Aktobe region.
The authorized body for the purpose of targeted social assistance, and in rural areas - the akim of a village, village, rural district creates conditions for the normal operation of the Commission (provides a separate room for the duration of the meeting, provides regulatory legal acts, technical means).
The Commission consists of representatives of local government bodies, public associations, associations of property owners, simple partnerships of apartment buildings (simple partnerships), the population, organizations and authorized bodies of education, health, social protection of the population, law enforcement officials.
The Commission consists of a chairman, a secretary and members of the Commission. The total composition of the Commission is at least five people.
The Chairman organizes the work of the Commission and ensures timely and high-quality performance of the tasks and functions assigned to the Commission by this Regulation.
Notification of the applicant about the date of the meeting, preparation of proposals on the agenda of the Commission meeting, necessary documents, materials and registration of the minutes of the Commission meeting after it is carried out by the Secretary of the Commission.
The applicant, if desired, is present at the meeting of the Commission.
Commission:
within seven working days from the date of receipt of documents from the career center or akim of the village, village, rural district prepares a conclusion based on the submitted documents and (or) the results of the examination of the financial situation of the applicant who applied for the appointment of targeted social assistance and transmits it to the career center or akim of the village, village, rural district;
within two working days from the date of receipt of the documents, conducts an examination of the applicant, according to the results of which he draws up an act on the financial situation of the person (family) who applied for social assistance, prepares a conclusion on the need or lack of need of the person (family) in social assistance in accordance with the Rules, and sends them to the authorized body or akim settlement, village, rural district.
The decisions of the Commission are valid in the presence of two-thirds of the total number of its members.
The Commission's decisions are taken by open vote and are considered adopted if a majority of votes from the total number of Commission members are cast for them. In case of equality of votes, the vote of the Chairman of the Commission is considered decisive.
The Commission's decision is made in the form of a conclusion, with which the applicant is familiarized with the signature.
In case of disagreement, the conclusion of the Commission is appealed by the applicant to the authorized body, as well as in court.
