Result of public service provision
A decision on the construction of religious buildings( structures), determining their location, or a reasoned response to the refusal to provide public services.
The form of providing the result of rendering a public service is paper and (or) electronic.
Condition for issuing the result of rendering a public service:
through the service provider: delivery of documents to the service recipient is carried out by mail through the office of the service provider or on purpose upon presentation of an identity card (or its representative under a notarized power of attorney) upon presentation of a copy of the application of the service recipient with the service provider's stamp;
through a State Corporation: issuance of documents to the service recipient is carried out on the basis of a receipt for acceptance of the relevant documents upon presentation of an identity card (or its representative under a notarized power of attorney);
through the Portal the result of rendering the state service goes to "private office" of the applicant in the form of electronic document signed by electronic digital signature (hereinafter – EDS) of the authorized person provider.
The state Corporation provides storage of the result for 1 (one) month, after which it is transferred to the service provider for further storage for 1 (one) year. When the service recipient applies after 1 (one) month, at the request of the state Corporation, the service provider within 10 (ten) business days sends the finished result of rendering the state service to the state Corporation for delivery to the service recipient.

Schedule
1) service provider - Monday through Friday, in accordance with the established schedule of work from 9.00 to 18.30, except weekends and holidays, according to Labor code of the Republic of Kazakhstan dated November 23, 2015 (hereinafter-the Code) with a lunch break from 13.00 to 14.30 hours;
2) State Corporation – from Monday to Saturday inclusive, in accordance with the established work schedule from 9.00 to 20.00 hours without a lunch break, except for Sundays and public holidays, in accordance with the labor legislation of the Republic of Kazakhstan.
The state service is provided at the location of the service provider in the order of an electronic queue, without accelerated service, it is possible to book an electronic queue through the Portal;
3) Portal-around the clock, except for technical breaks in connection with repair work (when the service recipient applies after the end of working hours, on weekends and holidays, according to the labor legislation of the Republic of Kazakhstan, the application is accepted and the result of the state service is issued on the next working day).

List of documents required for the provision of public services
When the service recipient (or its representative by proxy) applies to the service provider and the State Corporation (upon presentation of an identity document for identification), the following documents are submitted::
1) application form in accordance with Annex 1 to these rules for the provision of public services;
2) explanatory notes on the construction of cult buildings (constructions) in a free form, signed by the head of a registered religious associations (including the names of religious buildings (structures) and religious associations, to whom it would belong to, the construction, the number of parishioners in need of spiritual needs on the administrative-territorial unit (village, town, rural district, district in city, town, district, region), the candidacy of the priest religious buildings (structures);
3) a copy of the decision of the Assembly (gathering) of local community or decision of the meeting of owners of premises (apartments), operating on the territory, where the construction of cult buildings (constructions), of the agreement on the construction of cult buildings (constructions) (subject to availability of houses bordering it (including, if the border runs easement, road) with the territory of religious buildings (structures).
Confirmation by the service provider of the documents listed in this paragraph from the applicant, is a copy of the statement of the applicant with stamp of the service provider containing the date, time of administration and number of incoming documents, with the indication of surname, name, patronymic (if available) of the person who accepted the documents.
When accessing the Portal:
1) an application in the form of an electronic document signed by the service recipient's EDS;
2) an electronic copy of the reference – justification on the construction of cult buildings (constructions) in a free form, signed by the head of a registered religious associations (including the names of religious buildings (structures) and religious associations, to whom it would belong to, the construction, the number of parishioners in need of spiritual needs on the administrative-territorial unit (village, town, rural district, district in city, town, district, region) the nomination of the priest religious buildings (structures);
3) electronic copy of the decision of the Assembly (gathering) of local community or decision of the meeting of owners of premises (apartments), operating on the territory, where the construction of cult buildings (constructions), of the agreement on the construction of cult buildings (constructions) (subject to availability of houses bordering it (including, if the border runs easement, road) with the territory of religious buildings (structures).

Grounds for refusal to provide public services established by the legislation of the Republic of Kazakhstan
1) if the activities of religious associations are aimed at establishing the supremacy of one religion in the state, inciting religious hatred or discord, including those related to violence or calls for violence and other illegal actions;
2) if the activities of religious associations are aimed at forcing citizens of the Republic of Kazakhstan, foreigners and stateless persons to determine their attitude to religion, to participate or not participate in the activities of a religious Association, in religious rites and (or) in teaching religion;
3) if the activities of religious associations are aimed at violence against citizens of the Republic of Kazakhstan, foreigners and stateless persons or other harm to their health, or at the dissolution of marriage between spouses (family breakdown) or termination of kinship relations, damage to morals, violation of human and civil rights and freedoms, encouraging citizens to refuse to perform duties provided for by the Constitution and laws of the Republic of Kazakhstan, and other violation of the legislation of the Republic of Kazakhstan;
4) if the activities of religious associations are aimed at forcibly involving citizens of the Republic of Kazakhstan, foreigners and stateless persons in their activities, including through charity, and (or) preventing them from leaving a religious Association, including through the use of blackmail, violence or the threat of its use, using material or other dependence of citizens of the Republic of Kazakhstan, foreigners and stateless persons, or by deception;
5) if the activity of religious associations is aimed at inducing participants (members) of a religious Association and religious followers to alienate their property in favor of the religious Association, its leaders and other participants (members);
6) if the activities of religious associations are aimed at encouraging decision-making and performing actions using religion and religious beliefs that are obviously capable of disorganizing the activities of state bodies, disrupting their smooth functioning, or reducing the degree of governance in the country;
7) establishing the unreliability of the documents submitted by the service recipient for receiving the state service, and (or) the data (information) contained in them;
8) in respect of the service recipient, there is a court decision (sentence) that has entered into legal force prohibiting activities or certain types of activities that require receiving a public service.
9) in respect of the service recipient, there is a court decision that has entered into legal force, on the basis of which the service recipient is deprived of a special right related to receiving a public service.
