general provisions
1.1. The department for the preparation of proposals for the provision and withdrawal of land plots (hereinafter referred to as the department) is a structural subdivision of the State Institution "Department of Agriculture of the Aktobe region" (hereinafter referred to as the Department) and operates under the leadership of the head of the Department.
1.2. The structure, staffing of the Department is determined by the staffing table of the Office.
1.3. The department does not have structural divisions that are part of the department.
2. The main tasks and functions of the department
2.1. The main tasks and functions of the department are:
1) assistance to the activities of the management within the framework of the assigned powers;
2) preparation of proposals and draft decisions of the local executive body of the region on the provision of land plots for the purpose of subsoil use (for carrying out mining operations; for combined exploration and production; for the construction and (or) operation of underground structures not related to exploration and (or) production ), construction (reconstruction) of main pipelines, oil and gas processing facilities, facilities for the use of renewable energy sources, for industrial and innovative projects of subjects of industrial and innovative activities, the implementation of investment priority projects in accordance with the Entrepreneurial Code of the Republic of Kazakhstan, the creation and expansion of specially protected natural areas of local importance, as well as for the compulsory alienation of land plots for state needs in the discovery and development of mineral deposits, for the construction (reconstruction) of trunk pipelines, the creation and expansion of special more protected natural areas of local importance;
3) preparation of proposals and draft decisions of the local executive body of the region on the provision of land plots to state research organizations and their experimental farms, as well as state seed farms, breeding plants;
4) preparation of proposals and draft decisions of the local executive body of the region on the establishment of easements in accordance with Article 69 of the Land Code;
5) preparation of proposals for land reservation in accordance with Article 49-2 of the Land Code of the Republic of Kazakhstan;
6) preparation of proposals and draft decisions of the local executive body of the region on the provision of land plots occupied by territorial waters for the construction of artificial structures;
7) organization of land tenders (tenders, auctions) within its competence;
8) preparation of contracts of sale and purchase and lease agreements for a land plot and temporary free land use within the limits of its competence and control over the fulfillment of the terms of the concluded agreements;
9) placement of information with lists of persons who received the land plot;
10) preparation of proposals and draft decisions of the local executive body of the region on the provision and seizure of land plots for the needs of defense and national security;
11) determination of the divisibility and indivisibility of land plots within its competence;
12) preparation of proposals for the issuance of permits by the local executive body of the region for the use of land plots for exploration work in accordance with Article 71 of the Land Code of the Republic of Kazakhstan;
13) preparation of proposals and draft decisions of the local executive body of the region on the use of land plots for mineral exploration and geological study in accordance with article 71-1 of the Land Code of the Republic of Kazakhstan;
14) organization of the work of the regional special commission and on-site visits according to the preliminary selection of land plots for the construction of facilities in accordance with the legislation of the Republic of Kazakhstan;
15) organization of the work of the regional land commission;
16) ensuring the implementation of the Standards and Regulations for the provision of public services;
17) keeping records of receipts of agricultural losses to the republican budget;
18) examination of projects and schemes of regional, city, district significance, affecting the use and protection of land;
19) provision of high-quality, timely information to the Land Management Committee of the Ministry of Agriculture of the Republic of Kazakhstan, the regional akimat and other departments and administrations of the region;
20) preparation of materials for the reports of the head of the department;
21) other tasks assigned by legislation and regulatory legal acts.
Powers and rights
3.1. For the purpose of timely and high-quality performance of the functions assigned and within the competence of the department, the department has the right to:
1) request and receive, free of charge, from enterprises, organizations, institutions of the region, regardless of their forms of ownership and subordination, as well as departments of management, the necessary documents and materials, information on issues related to the activities of the management;
2) participate in meetings, meetings, seminars and other events related to issues of management activities at the discretion of management;
