Chapter I. General rules

1. The state institution "Munayly District Department of Entrepreneurship and Agriculture" is a state body of the Republic of Kazakhstan that exercises leadership in the field of implementation of state policy on the development of entrepreneurship and agriculture in Munayly District.
2. The state institution "Oil District Department of Entrepreneurship and Agriculture" carries out its activities in accordance with the Constitution of the Republic of Kazakhstan and laws in the field of entrepreneurship, acts of the President and Government of the Republic of Kazakhstan, other normative legal acts, as well as these Rules.
3. The state institution "Oil District Department of Entrepreneurship and Agriculture" is a legal entity with an organizational and legal form, has its own seal and stamps in the state language, forms of the prescribed model, as well as accounts with treasury bodies in accordance with the legislation of the Republic of Kazakhstan.
4. The state institution "Oil District Entrepreneurship and Agriculture Department" enters into civil-legal relations on its own behalf.
5. The state institution "Oil District Department of Entrepreneurship and Agriculture" has the right to be a party to civil-legal relations on behalf of the state if it is authorized to do so in accordance with the legislation..
6. The state institution "Oil District Department of Entrepreneurship and Agriculture" takes decisions formalized by the orders of the head of the state institution "Oil District Department of Entrepreneurship and Agriculture" and other acts provided for by the legislation of the Republic of Kazakhstan in accordance with the procedure established by the legislation.
7. The structure and the limit of the number of employees of the state institution "Oil District Department of Entrepreneurship and Agriculture" are approved in accordance with the current legislation..

11. The financing of the activities of the state institution "Oil District Department of Entrepreneurship and Agriculture" is carried out from the local budget.
12. It is forbidden to enter into contractual relations with business subjects of the state institution "Oil District Entrepreneurship and Agriculture Department" in the context of the performance of duties that are the functions of the state institution "Oil District Entrepreneurship and Agriculture Department".
13. If the state institution "Oil District Department of Entrepreneurship and Agriculture" is given the right to perform income-generating activities by legislative acts, then the incomes received from such activities shall be sent to the state budget, unless otherwise specified by the legislation.

Chapter II. The mission, main tasks, functions, rights and duties of the state institution "Oil District Department of Entrepreneurship and Agriculture"

14. The mission of the state institution "Oil District Department of Entrepreneurship and Agriculture" is:

It is to provide state support for entrepreneurship in the region, create the most favorable conditions for the development of entrepreneurship, expand the infrastructure of entrepreneurship and promote it, ensure price stability in trade markets and state policy in the field of agriculture and tourism.

15. Duties:

1) creating the most favorable conditions for the development of entrepreneurship;

2)implementation of measures for persons interested in seasonal opening of temporary trade points, square (alankai) trade points selling garden products on the territory of the district;

3) organization of participation in various Republican, regional and district events related to business entities of the district;     

4) Ensuring implementation of investment policy in Munayly district, increasing investment attractiveness, development of industry and local coverage;

5) ensuring the implementation of state programs on attracting investments and industrial development;

6) creating favorable conditions for the development of priority sectors of the district economy;

7) providing conditions for the development of new competitive industries.

8) providing state support for entrepreneurship, agricultural activities;

9) implementation of state technical inspection in the field of agro-industrial complex;

10)ensuring the implementation of tourist policy, increasing tourist attraction, the name of the city or district;

11)ensuring the implementation of state programs in the field of tourism;

12)development of the regional cultural-tourist cluster and provision of further development of the tourist infrastructure of the region;

13)  increasing the contribution of the tourism sector to the economy of the district.

16. Functions:

• implementation of state programs related to entrepreneurship, agriculture and tourism in the region, monitoring in the field of small and medium business development;
• issuing permits for the sale of vegetable and horticultural products in the seasonal period and warning and explaining the shortcomings to persons who shop in unspecified places in the district;
• monitoring the prices of goods of social importance in the district and implementing the policy on price stabilization;
• organization of exhibitions and fairs;
• in cooperation with financial organizations (banks, micro-organizations, funds, etc.), to provide assistance to regional entrepreneurs on state support;
• development of measures to create favorable conditions for the development of entrepreneurship and agricultural activities in the district;
• coordinating the activities of the Expert Council on entrepreneurship issues under the district administration;
• providing assistance in solving administrative problems to subjects of industrial and innovative activity, industrial enterprises within their competence;
• assistance in determining the need for personnel in the implemented projects and in the operating enterprises of the manufacturing industry;
• assistance in the organization of events (forums, exhibitions, seminars, consultations, etc.) on attracting investments, developing industry and local content;
• collection of information on investment projects, implementation of analysis and presentation of industrial and innovative activities to the regional executive body in the field of state support;
• assisting in the organization of the work of the Regional Investment Council in order to analyze problematic issues and obstacles that hinder the attraction of investments, the implementation of investment projects;
• making proposals for the development of specific areas of economic sectors, including the industrial sector of the economy;
• conducting an analysis of the current state of attracting investments to the district economy;
• identify projects requiring investments for potential investors and ensure preparation of relevant documents;
• Participation in the development of the annual action plan for attracting investments to the Munayly district and ensuring its implementation;
• participation in the development and implementation of state programs, district development programs in the area of ​​development of industry, including processing industry;
• analysis of the current state of industry and manufacturing industry and forecast of economic indicators;
• assistance in organizing events (forums, exhibitions, seminars, meetings, etc.);
• implementation and coordination of state policy in the field of tourist activities in the region;
• promoting investment in tourism in the region;
• Conducting negotiations with potential investors and businessmen in order to attract them to participate in the implementation of tourism projects in the territory of the district and carrying out searches;
• forming an electronic database of all projects in the field of tourism in the district;
• creation of conditions for tourism business cooperation between districts;
• keeping records of all tourists in the district, including hotels and natural objects;
• annual inventory of tourism objects, creation and updating of the electronic database of objects shown in the territory of the district;
• conducting an analysis of the tourist service market and providing the management body with the necessary information on the development of tourism in the district;
• development and implementation of measures for the protection of district tourist resources;
• participation in planning and construction of tourist industry facilities in the region;
• providing methodical and consultative assistance to tourist service subjects in matters related to the organization of tourist service;
• develops an action plan for the development of the tourism industry in agreement with the management body;
• in the interest of local state administration, exercises other powers assigned to the state institution of the district by the legislation of the Republic of Kazakhstan.
• monitoring the macro-economic indicators of the agricultural sector in the district, collecting information on the work of producers of livestock and crops, vegetable production, conducting forecasts and analyses;
• ensuring the implementation of activities on the agro-industrial complex, introducing advanced technology and equipment to agriculture, effective use of agricultural lands, development of new pastures, meadows and arable lands, watering them, supplying them with fodder and water.

• control of accounting collections prepared by accounting, analysis of submitted reports and their set, submission to the necessary authorities and control over the preparation of local budget programs, full utilization of planned funds;

• Taking appropriate measures for digitization in the state institution "Oil District Department of Entrepreneurship and Agriculture";

17. Rights and obligations:

1)has the right to request and receive the necessary information from state bodies, legal entities with state participation and other organizations within the scope of his competence;

2) participate in the preparation of drafts of decisions of the district akimat and maslikhat on issues within the competence of the department;

3) Performs other rights and duties in accordance with the laws of the Republic of Kazakhstan.

Chapter III. Organization of activities of the state institution "Oil District Entrepreneurship and Agriculture Department".

18. The first head of the state institution "Oil District Entrepreneurship and Agriculture Department" is independently responsible for the performance of the duties assigned to the state institution "Oil District Entrepreneurship and Agriculture Department" and for the implementation of its functions..
19. The first head of the state institution "Munayly district department of entrepreneurship and agriculture" is appointed and dismissed by the akim of Munayly district.
20. The authority of the first head of the state institution "Oil district entrepreneurship and agriculture department":

1) determines the authority and duties of department specialists;

2) appoints and dismisses department employees in accordance with legislation;

3)issues orders and assigns appropriate tasks to all employees of the department;

4) Acts on behalf of the institution without a power of attorney;

5)approves the staff table within the established limits of the department's number of employees and labor payment fund;

6) solves the issue of remuneration, financial assistance, and disciplinary punishment to employees of the department in accordance with the procedure established by legislation;

7) takes measures to fight corruption and is personally responsible;

8) conclude contracts, issue power of attorney, open bank accounts and make other transactions;

9) Other issues in the organization of the activities of the state institution "Oil District Department of Entrepreneurship and Agriculture", rights and duties of employees are determined by the work regulations of the state institution "Oil District Department of Entrepreneurship and Agriculture".

10) In the absence of the first head of the state institution "Oil District Entrepreneurship and Agriculture Department", his powers are performed by the person who replaces him in accordance with the current legislation.

Chapter IV. The property of the state institution "Oil District Entrepreneurship and Agriculture Department".

21. The state institution "Oil District Department of Entrepreneurship and Agriculture" may have isolated property under the right of operational management in the cases stipulated by the legislation.

          The property of the "Oil District Department of Entrepreneurship and Agriculture" state institution is formed from the property given to it by the owner, as well as the property purchased as a result of its activities (including cash income) and other sources not prohibited by the legislation of the Republic of Kazakhstan.

22. The property assigned to the state institution "Oil District Department of Entrepreneurship and Agriculture" belongs to communal property.
23. If the legislation does not provide otherwise, the state institution "Oil District Department of Entrepreneurship and Agriculture" shall not have the right to dispose of the property approved for it and the property purchased from the funds allocated to it under the financing plan, or to dispose of it in any other way.

Chapter V. Reorganization and liquidation of the state institution "Department of Oil District Entrepreneurship and Agriculture".

24. Reorganization and liquidation of the state institution "Department of Oil District Entrepreneurship and Agriculture" is carried out in accordance with the legislation of the Republic of Kazakhstan.
