Fictitious Contracts and Money Laundering: Embezzlement Scheme Uncovered at Shymkent University

The Department of the Financial Monitoring Agency (AFM) in the city of Shymkent has completed an investigation into the embezzlement of budget funds on a particularly large scale and the legalization of criminally obtained assets at the M.Auezov South Kazakhstan University.

Among the suspects are the acting rector, the directors of the financial and administrative departments, as well as the heads of affiliated contracting organizations.

The investigation established that the university had signed fictitious contracts for services, construction and installation works, and the supply of goods totaling 256 million tenge.

However, the specified works were not actually carried out, and the budget funds were transferred to the accounts of affiliated contractors based on forged certificates of completed work, and subsequently cashed out.

With the proceeds of the crime, the suspects purchased six luxury vehicles (including a Mercedes-Benz S-Class, Lexus LX570, and others) and a luxury cottage in the center of Shymkent, with a total value of 254 million tenge. These assets have been seized with court approval.

Four of the suspects have been placed under house arrest.

The criminal case has been submitted to court.

A farm on paper — real estate in reality: subsidies spent by the suspect for personal gain.

The Department of the Financial Monitoring Agency (FMA) for the West Kazakhstan Region has completed an investigation against the head of a credit partnership on charges of embezzling subsidies totaling 150.7 million tenge.

The suspect illegally obtained preferential loans under the "Agrobusiness" lending program in the amount of 126.7 million tenge for a controlled peasant farm.

Subsequently, the loan funds were withdrawn from the farm’s account without the actual purchase of cattle.

In addition, by entering false information into the "ISZh" database about non-existent livestock, the suspect unlawfully received 24 million tenge in subsidies allocated under the national project "Development of the Agro-Industrial Complex for 2017–2021."

To legitimize the receipt of subsidies, the suspect submitted fake documents claiming the purchase of pedigree cows from other peasant farms.

Using the criminal proceeds, the suspect purchased land plots on which he built a shopping center and a sauna, registering the properties in the name of a relative to conceal ownership.

By court order, the suspect’s assets worth 198 million tenge have been seized: 2 land plots, a shopping center, a sauna, and a vehicle (Exeed LX).

The suspect has been placed in pre-trial detention as a preventive measure.

Verdict Delivered in the Capital on the Embezzlement of 8.5 Billion Tenge During Wind Power Plant Construction.

A verdict has been delivered in the capital against former Maslikhat deputy A. Belentseva and D. Mergenbayev for large-scale embezzlement.

The investigation was conducted by the Financial Monitoring Agency’s Department for Astana.

In 2020, following procurement procedures, the convicted individuals, on behalf of LLP “Olimp Trans Service,” signed a contract to construct a wind power plant in the Yereymentau district for a total of 23.2 billion tenge.

By issuing fictitious contracts, they transferred funds to affiliated companies’ accounts, followed by cash withdrawals.

The damage caused amounted to over 8.5 billion tenge.

By court order, assets worth 13 billion tenge — including a plant, a recreation base, special equipment, and vehicles — have been seized.

By the court's verdict, Belentseva was found guilty and sentenced to 8 years and 6 months of imprisonment. Mergenbayev was sentenced to 6 years and 8 months of imprisonment.

In addition, the court upheld a civil claim for 8.5 billion tenge.

The seizure of assets will remain in place until the civil claim is resolved.

The verdict has not yet entered into legal force.
