On the sale of seized property through an electronic trading platform
As part of the enforcement proceedings, the bailiff issues a resolution on the transfer of the debtor's property for sale. Then sends the application to the unified electronic trading platform for the auction.
Unified electronic trading platform is an information system, a set of databases, technical, software, telecommunications and other means that provide the possibility of entering, storing and processing information necessary for conducting an electronic auction, providing a single public access point to participants of an electronic auction.
The announcement of the upcoming electronic auction is published on the unified electronic trading platform no later than ten calendar days before the electronic auction.
Persons wishing to participate in the electronic auction are required to submit an application and pay a guarantee fee in the amount of five percent of the original value of the property.
The guarantee fee of the winner of the electronic auction is credited to the purchase price. The electronic auction begins to increase the value of the property with a fixed step from the estimated value specified in the resolution on the transfer of the debtor's property for sale.
If none of the participants of the electronic auction increases the value of the property by maintaining a predetermined bidding step, then the auction is declared invalid.
If the auction is declared invalid and the claimant refuses to retain the property, the bailiff, after ten working days from the date of the first auction, appoints a repeat auction. At the same time, the initial price of the realizable property is lowered with a fixed step until one of the participants agrees to buy the property at the announced price, which should not be less than fifty percent, and in respect of real estate not less than seventy-five percent of the estimated value of the property put up for electronic auction.
