Notaries in the Republic of Kazakhstan is a legal institution providing qualified legal assistance that protects the rights and legitimate interests of individuals and legal entities by performing notarial actions. Legislation on notaries consists of the norms of the Civil code, this Law and other legislation of the Republic of Kazakhstan regulating notarial activities. Notarial activity is the performance by a notary of notarial actions provided for by this Law and other legislative acts of the Republic of Kazakhstan. In cases and within the limits established by this Law, separate notarial actions may be performed by specially authorized officials. Notarial activity in the Republic of Kazakhstan is based on the principles of legality, independence, impartiality, secrecy of notarial actions. Notarial activity is not a business activity. In carrying out notarial activities, notaries and other persons authorized to perform notarial acts are independent and subject only to the law. At the same time, they are guided by this Law and other regulatory legal acts, as well as international treaties ratified by the Republic of Kazakhstan regulating such activities. Information about notarial actions and documents shall be issued at the written request of the court, investigation and inquiry bodies, in cases under their proceedings, bailiffs in cases under their enforcement proceedings to the Prosecutor's office, as well as to justice bodies and notary chambers authorized by this Law to verify the activities of notaries. A notary can be a citizen of the Republic of Kazakhstan who has reached the age of twenty-five years, has a higher legal education, work experience in the legal profession for at least two years, has passed an internship with a notary for at least one year, has been certified by the attestation Commission of justice and has received a license to engage in notarial activities, unless otherwise provided by this Law.
