Permission to use a work is required. However, Article 39 of the Law of the Republic of Kazakhstan "On Copyright and Related Rights" allows for the use of phonograms without the copyright holder's consent, but with the payment of a royalty. Article 31 of the Law of the Republic of Kazakhstan "On Copyright and Related Rights" provides for the use of rights under a copyright agreement. Concluding an appropriate agreement with a collective management organization and paying the copyright and related royalties will be sufficient for the commercial use of works.
