According to paragraph 1 of Article 35, paragraph 2 of Article 76-1 of the law, persons who have allowed illegal interference in the activities of lawyers or legal consultants or who impede the implementation of such activities are brought to justice in accordance with the law.
Obstruction of the lawful activities of a lawyer or legal consultants is the basis for initiating administrative proceedings in accordance with Article 668 of the Code of the Republic of Kazakhstan "On Administrative Offenses" (hereinafter referred to as the RKCOAP).
In pursuance of Article 668 of the RKCOAP, obstruction of the lawful activities of a lawyer or legal consultants, expressed in failure to submit or refusal to submit, within the timeframes established by law upon written request, the necessary documents, materials or information required for the performance of their professional duties, if these actions do not have the characteristics of a criminal offense, entails a fine for officials in the amount of fifteen, for legal entities - in the amount of twenty monthly calculation indices.
