An industrial design differs from a trademark in that an industrial design is a part of a product, inseparable from it, while a trademark is placed on the product and is not a part of it. A trademark is a means of individualizing goods, works and services rendered to it. The fundamental difference between a three-dimensional trademark and an industrial design is that a three-dimensional trademark must have distinctiveness. This is the main requirement for trademarks. Such a requirement is not imposed on an industrial design.
