The issues of protecting intellectual property rights on digital platforms are becoming increasingly important in the context of rapid technological development and digitalization of society. Digitalization is growing at an incredible speed and is invading all spheres of human activity, giving rise to new relationships.
The key issues include the following: parody and copyright, the role of information intermediaries, violations of rights on the Internet, digital assets and legislation.
The legislation provides for the following protection mechanisms:
- Pre-trial settlement: the copyright holder can send a claim to the user or operator of the website with a demand to remove content that violates his rights.
- Judicial protection: if the claim is not satisfied, the copyright holder has the right to go to court with a claim to protect violated rights. The legislation provides for the possibility of demanding compensation for damages or compensation for harm, as well as blocking access to a site distributing illegal content. - Contacting law enforcement agencies: if there are signs of a criminal offense, you can file a complaint with law enforcement agencies to hold the offender accountable under Article 198 of the Criminal Code of the Republic of Kazakhstan.
