The issues of improving the system of providing public services to the population occupy an important place in the activities of the judicial authorities, aimed at achieving a more effective performance of their functions. One of the public services provided by the Department of Justice of the Kostanay region is the apostille of official documents originating from the judicial authorities, the RAGS and notaries of the Republic of Kazakhstan on the principle of extraterritoriality.
When traveling abroad, Kazakh documents must have legal force on the territory of another state. One of the procedures that confirms its authenticity and proper registration is the affixing of the "apostille" stamp.
The apostilled document can be used in any of the more than 140 countries participating in the Hague Convention. No additional confirmation of the authenticity of the document is required.
To affix an apostille, you must:
1) Submit the documents to the "State Corporation" Government for Citizens", pay the state duty in the amount of 1458.5 tenge. The term for the provision of public services through the State Corporation "Government for Citizens" is 2 (two) working days (the day of reception is not included in the term for the provision of public services).
2) Or through the e-government portal. Within the framework of the pilot project, the receipt of public services in electronic form through the E-Apostille IP was implemented. The procedure is simple – log in to the portal, fill in the fields of the electronic request and attach a scanned copy of the apostilled document, pay the state fee and send the application, certifying it with an electronic digital signature.
The Department of Justice checks the compliance of the signature of the official and the seal of the state body, as well as the presence of the authority to sign the official document that signed the document. In case of compliance of the application and submitted documents of the service recipient with the requirements of the Rules, the service provider forms an electronic apostille on the electronic document subject to apostille and sends the result of the provision of the state service signed by the authorized person to the" personal account " of the service recipient on the portal.
