Advocacy – legal assistance provided on a professional basis by lawyers in accordance with the procedure established by this Law in order to protect and promote the rights, freedoms and legitimate interests of individuals and legal entities. The legislation of the Republic of Kazakhstan on advocacy and legal assistance is based on the Constitution of the Republic of Kazakhstan, consists of this Law and other regulatory legal acts of the Republic of Kazakhstan regulating advocacy and legal assistance. The legal profession in the Republic of Kazakhstan is designed to promote the implementation of human rights guaranteed by the state and enshrined in the Constitution of the Republic of Kazakhstan for the judicial protection of their rights, freedoms and legal assistance, as well as to promote the peaceful settlement of disputes. A lawyer is a citizen of the Republic of Kazakhstan who has a higher legal education, has received a license to practice law, is a member of the bar Association and provides legal assistance on a professional basis within the framework of legal activities regulated by this Law. A lawyer may not be the person recognized by the court as incapable or partially capable or has unspent or removed in the manner prescribed by law a criminal record. The rights of a lawyer are not subject to restrictions, except in cases expressly provided for by the laws of the Republic of Kazakhstan. Interference or hindrance of legal advocacy shall entail liability provided for by the laws of the Republic of Kazakhstan. The lawyer is obliged to conclude a contract of professional liability insurance for obligations arising as a result of causing harm to third parties who are provided legal assistance in accordance with the contract, as a result of providing such assistance. Privilege are a fact of access to a lawyer, information about the content of oral and written negotiations with the person seeking help, and others, on the nature and results undertaken in the interests of the person seeking help, actions, and other information relating to the provision of legal aid.
